<br /> Page 4 of 10 Page 4 <br />Formatted: Right <br />SECTION VI. <br />Contractor shall comply with all applicable statutes, ordinances, rules, regulations, and orders of <br />all public agencies and authorities relating to the aerial application of pesticides over residential areas. <br />SECTION VII. <br />No waiver or modification of this Agreement or of any covenant, condition or limitation herein <br />contained shall be valid unless in writing and duly executed by the party to be charged therewith and <br />no evidence of any proceeding, arbitration, or litigation between the parties hereto arising out of or <br />affecting this Agreement, or the rights or obligations of the parties hereunder, unless such waiver or <br />modification is in writing, duly executed as aforesaid and the parties further agree that the provisions of <br />this section may not be waived as herein set forth. <br />SECTION VIII. <br />Contractor will secure public liability insurance in the minimum amounts as follows: <br />• Non-Chemical: <br />- $5,000,000 Public Liability (bodily injury and property damage) combined single limit. <br />• Chemical: <br />- $500,000 each person bodily; <br />- $500,000 each occurrence bodily; and, <br />- $500,000 each occurrence property. <br />• Chemical coverage includes "all labeled products for mosquito control" <br />• Chemical coverage includes "cities and towns and residential areas" <br />• Coverage includes the County as a fully insured additional insured
