<br />(d) "Grantee" means Cablecom of Fargo and/or any lawful <br />successor assignee. <br /> <br />(e) "FCC" means the Federal Communications Commission. <br /> <br />SECTION 3. TERM AND GENERAL PROVISIONS OF AGREEMENT <br /> <br />The County hereby grants to Cablecom of Fargo a non-exclusive <br />franchise, for a period of fifteen (15) years from the effective <br />date hereof, to construct, operate and maintain throughout the <br />County, in, upon, along, across, above, over and under the streets, <br />alleys, easements, public ways and public places as now laid out or <br />dedicated, and all extensions thereto, a system of wires, poles, <br />cables, underground conduits, ducts, trenches, conductors, <br />amplifying equipment, manholes, fittings, and any and all other <br />fixtures, appliances and appurtenances necessary for the <br />construction, operation and maintenance in the unincorporated areas <br />of the County of a Cable Television System for the purpose of <br />distribution of Cable Television and related services to the <br />residents of the County. <br /> <br />SECTION 4. FRANCHISE NON-EXCLUSIVE <br /> <br />Neither the granting of this Franchise, nor any of the provisions <br />contained herein, shall be construed to prevent the County from <br />granting another Franchise to any person or corporation other than <br />the Grantee; provided, however, that any such additional franchise <br />shall not authorize an additional grantee to operate within the <br />territory of the Grantee on terms or conditions more favorable or <br />less burdensome to such new grantee than those applied to the <br />Grantee. <br /> <br />SECTION 5. COMPLIANCE WITH APPLICABLE LAWS <br /> <br />The Grantee shall at all times during the life of this Franchise be <br />subject to all lawful exercise of the police powers of the County <br />and to such reasonable regulations as state or federal laws shall <br />hereafter provide. <br /> <br />SECTION 6. <br /> <br />FRANCHISE TERRITORY <br /> <br />This Agreement shall apply to the unincorporated areas of the <br />County. The Grantee shall be required to construct its System in <br />all areas of the County which meet a standard density of forty (40) <br />homes per additional plant mile as measured from the Grantee's <br />existing plant. Nothing herein contained is intended to preclude <br />the Grantee from extending its cables and equipment to other areas <br />of the County. <br /> <br />- 2 - <br /> <br />,.,","".".~.. .
