Street South <br />Fargo, NO 58103 <br /> <br />Dear Chairman Vanyo: <br /> <br />Cable One is proud to provide cable television and Internet service to the citizens of Cass County <br />and highly values its enduring relationship with the County and its residents. We have done our <br />best to provide the County with the high quality cable television service that it deserves and we <br />look forward to providing this service for many years to come. Therefore, because our current <br />franchise agreement with the County is due to be renewed on or before August 29, 2009, we <br />hereby notify you that we seek renewal of our cable television franchise with Cass County. <br /> <br />The Cable Communications Policy Act of 1984 and the Cable Television Consumer Protection <br />and Competition Act of 1992 ("Cable Act") encourage franchising authorities and cable <br />companies to reach a franchise renewal agreement at any time, through informal discussions. We <br />look forward to negotiating a mutually satisfactory agreement with you through this process. <br />While we believe that the fonnal renewal process embodied in Section 626 of the Cable Act can <br />be cumbersome, we are required to notify you of our election to implement the Cable Act's <br />procedures and standards in the event that a mutually satisfactory franchise renewal cannot <br />otherwise be achieved. I am enclosing a copy of the relevant renewal provisions of the Cable Act <br />for your information, <br /> <br />As a first step in the renewal process, we are requesting the commencement of a public <br />proceeding so that the future cable television-reIated needs and interests of the community might <br />be ascertained, as well as an evaluation of our performance during the current franchise period. <br />The Cable Act requires that the public be given both notice of the proposed franchise renewal and <br />an opportunity for participation in the franchise renewal process. We hope that this process will <br />elicit comments from the public, including subscribers and non--subscribers, along with an open <br />exchange with County officials. This input from the citizens and leaders of the County will be <br />taken into account in preparing a draft of a new franchise document that we will submit to you. <br /> <br />Cable One has made a substantial investment in the community and will continue to make capital <br />improvements as new technology and equipment becomes available. I believe our mutual goal of <br />high quality cable television service rests on the continuing partnership of Cable One and the <br />City. As you can imagine, the decisions to make these types of major expenditures are easier <br />
