<br />dwelling structure on the Property, and subject to the <br />following restrictions: <br /> <br />( I) Removal of vegetation, trees, and shrubs over an area <br />six feet wide or less is permitted only for placement of <br />a stairway or path tor access to the watercourse, <br />Complete removal of vegetation, trees, or shrubs is <br />otherwise prohibited. <br /> <br />(2) Limited pruning of tree limbs is pern1itted only for <br />purposes of providing visual access to the watercourse <br />from the principal dwelling structure on the Property, <br />and shall be in accordance with reasonable nursery <br />and landscape practices. <br /> <br />(3) Limited pruning and trimming of vegetation, <br />including trees and shrubs, may not substantially <br />reduce screening of structures or vehicles on the <br />Property as viewed from the \vatercourse under <br />normal summer "leaf-on" conditions. <br /> <br />(4) Limited pruning and trimming of vegetation, <br />including trees and shrubs, may not reduce existing <br />shade cover adjacent to the \vatercourse. <br /> <br />(5) Removal of dead, diseased, or dangerous trees, limbs, <br />or branches is permitted. <br /> <br />b, Owner agrees to maintain a modified Limited Disturbance Zone (the "mLDZ") on <br />the Property for a distance of25 feet, extending \vest from the western boundary of <br />the mMDZ, as depicted on the attached Exhibit. The following restrictions are <br />applicable within the boundaries of the mLDZ: <br /> <br />(i) Permanent structures are prohibited, except bike paths, walking trails, <br />or other multi-use paths: one accessory building, not exceeding two <br />hundred square feet, is permitted; and all existing buildings within the <br />boundaries of the mLDZ at the date the parties execute this <br />Agreement are exempt from these mLDZ restrictions. <br /> <br />(ii) Additional fill is prohibited, except till required to plant new trees or <br />vegetation tix restoration of the riparian area. <br /> <br />(iii) Grading is prohibited, except grading f()r bank restoration in areas <br />experiencing bank slumping. <br /> <br />(iv) On-site septic systems with drain iields are prohibited, except <br />existing on-site septic systems with drain fields within the boundaries <br /> <br />-3- <br />
