EASEMENT THIS AGREEMENT, made this _t :~ day of_~t..V!{1111l:L, 2006, by , and between Cass County, North Dakota, Grantor, and the City of West Fargo, North Dakota, having a post office address at 800 Fourth Avenue East, West Fargo, North Dakota, Grantee. WITNESSETH: That for and in consideration of the sum of One Dollar ($1.00) and other good and valuable considerations, the Grantor hereby gives, grants and quit claims unto said Grantee an Easement of right of way to construct and maintain a municipal water main and related appurtenances upon, under and through the following described tract of land, to-wit: That part of the Southeast Quarter (SE~) of Section 31, Township 140 North, Range 49 West, Cass County, North Dakota, being a strip of land 30.00 feet wide lying North of and adjacent to the following-described line: Commencing at the Southwest corner of sa id .southeast Quarter (SE~); thence East along the South line of said Southeast Quarter (SE~) tor a distance of 36.92 feet; thence North perpendicular to the North right-of-way line of Cass County Highway No. 10 for a distance of 104.73 feet to a point on the North right-of-way line of Cass County Highway No. 10; thence Easterly along the North right-at-way line of CaBS County Highway No. 10 for a distance at 984.52 feet to the point of beginning; thence continue Easterly along the North right-of-way line of Cass County Highway No. 10 for a distance of 921.19 feet, t:here terminating. Said tract contains 27 1636 square feet, more or less. To have and to hold the Easement of right of way unto the Grantee for the purposes herein stated.
