<br />Commission Minutes-September 5, 2006 3125 <br /> <br />MOTION, passed <br />Mr. Pawluk moved and Mr. Wagner seconded to deny abatements #4291 <br />and #4292 for Raymond Diemert, as recommended by the Director of <br />Equalization. Discussion: Mr. Vanyo was concerned about the <br />ramifications if the City of Buffalo bases their valuations on square <br />footage only and does not take into consideration any other factors. Mr. <br />Klein does not see a problem with the method used to compute the <br />assessments. Mrs. Sorum has an issue with the city approving one of <br />the requests and denying another without providing any reasons. On roll <br />call vote, the motion carried unanimously. <br /> <br />7. SUBDIVISION DEVELOPER AGREEMENTS, Chairman authorized to siQn <br />Mike Zimney, County Planner, was present. He said according to the newly adopted <br />subdivision ordinances, developers are required to sign a memorandum of understanding <br />with Cass County, agreeing that as part of the final plat approval, a developer is responsible <br />to complete all required improvements. Two options are available to applicants when <br />working toward satisfying the county's requirements. He said a financial security may be <br />provided to record the plat prior to completion of the improvements, and after an inspection <br />by the Cass County Highway Department the financial security will be released to the <br />developer. The other option is to complete all the requirements beforehand and the county <br />engineer will then sign the plat in order for it to be recorded. <br />MOTION, passed <br />Mr. Pawluk moved and Mrs. Sorum seconded to authorize the chairman <br />to sign the memorandum of understanding contract with Cass County <br />Electric Cooperative, developer of Torgerson First Subdivision, upon <br />receipt and subject to state's attorney approval. On roll call vote, the <br />motion carried unanimously. <br /> <br />MOTION, passed <br />Mr. Pawluk moved and Mrs. Sorum seconded to authorize the chairman <br />to sign the memorandum of understanding contract with John Massari, <br />developer of J Starr Subdivision, upon receipt and subject to state's <br />attorney approval. On roll call vote, the motion carried unanimously. <br /> <br />MOTION, passed <br />Mr. Pawluk moved and Mrs. Sorum seconded to authorize the chairman <br />to sign the memorandum of understanding contract with Wayne Lunder, <br />developer of Lunder Subdivision, upon receipt and subject to state's <br />attorney approval. On roll call vote, the motion carried unanimously. <br /> <br />8. VOUCHERS, Approved <br />MOTION, passed <br />Mrs. Sorum moved and Mr. Wagner seconded to approve Voucher No. <br />210,307 through Voucher No. 210,585. On roll call vote, the motion <br />carried unanimously. <br />
