If Birch can get this reviewed this morning, Heather could add it
to our afternoon agenda. because of your time constraints. Contracts are allowed by policy to be
submitted up to the day of the meeting.

We have several added items today, so one more is OK. The tower site is located
south of Fargo at the Horace / Hickson exit on 1-29. The agreement is for a period offive years
at $10,000 per year. The cost will be paid from 04 HS funds and will complete the expenditures
for the Fargo side of the project. At the end of the ternl, the City of Fargo will have the
responsibility for future costs and will have to determine whether they want to continue the lease
with AA T (the tower company) or move the equipment to another site.

The document appears to be a standard tower agreement. Jeff Nelson has reviewed the
agreement for technical issues and I asked Glenn Ellingsberg to also review the agreement as be
has some experience with tower issues. They both are comfortable with the language contained.

Because the grant runs out this month, I've already processed an invoice and the check will be
authorized at the commission meeting today. The term of the agreement begins 1 September, as
the contractor wants to get in and begin preparations for the equipment shelter.

My question is: Do I have authority to sign this agreement, or is this something that has to go to
