<br /> <br /> <br />June 17, 2020 <br /> <br />Mr. Joel Paulsen <br />Executive Director <br />FM Area Diversion Project <br />207 4th Street North, Suite A <br />Fargo, ND 58102 <br />RE: Easement for Cell Tower Relocation Required for Diversion Project <br />Dear Mr. Paulsen, <br />The Fargo-Moorhead Area Diversion Project (Project) requires the relocation of a cell phone <br />tower owned by SBA Communications Corporation (“SBA”) that is currently located within the <br />footprint of the proposed diversion channel. The cell phone tower is considered a utility <br />impacted directly by the Project, and therefore, it must be relocated at the expense of the <br />Diversion Authority. <br />Through negotiations and coordination with SBA, a number of potential relocation sites were <br />explored. After analyzing the sites, an agreement between SBA and the engineers representing <br />the Diversion Authority was reached that a site on OIN 728 is the most suitable location for <br />relocating the cell phone tower, and the cell phone service providers that utilize the tower have <br />given their approval of the replacement site. For information, OIN 728 was recently acquired by <br />CCJWRD for the Project and is available to accommodate this cell tower. <br />To facilitate the utility relocation, an easement will be required between CCJWRD and SBA. It is <br />recommended that the Diversion Authority concur with CCJWRD granting an easement on OIN <br />728 to SBA for the purposes of facilitating this utility relocation. <br />Please find two attached maps, showing the current and proposed cell tower locations, and the <br />proposed easement area. <br />Respectfully, <br /> <br />Eric C.
