<br />RELEASE OF RIGHT OF WAY EASEMENT

<br />THIS RELEASE, made and entered into this.
<br />
<br />day of ______, 2006, by
<br />
<br />CASS COUNTY, a political subdivision under the laws of North Dakota, whose post office address
<br />
<br />is PO Box 2806, Fargo, North Dakota 58108-2806.
<br />
<br />WITNESSETH:
<br />
<br />WHEREAS, CASS COUNTY is the owner of a perpetual easement for the laying out,
<br />
<br />construction, cleaning out, repairing, widening, deepening, extending and maintaining of a public
<br />
<br />drain under a Right of Way Easement dated August 30, 1967, and recorded in the office of the
<br />
<br />County Recorder in and for Cass County, North Dakota, on October 11, 1967, at 2:30 p.m., in Book
<br />
<br />"U-4" of Miscl., at page 3, as Document No. 419273; and
<br />
<br />WHEREAS, CASS COUNTY desires to release, cancel, and terminate the Right of Way
<br />
<br />Easement dated August 30, 1967, as described above;
<br />
<br />NOW THEREFORE, CASS COUNTY, for and in consideration of the sum of One Dollar
<br />
<br />($1.00) and other good and valuable consideration, the receipt and sufficiency of which CASS
<br />
<br />COUNTY hereby acknowledges, does hereby release, cancel, and terminate the above-described
<br />
<br />Right of Way Easement dated August 30, 1967, and recorded in the office of the County Recorder
<br />
<br />in and for Cass County, North Dakota, on October 11, 1967, at 2:30 p.m., in Book "U-4" ofMiscl.,
<br />
<br />at page 3, as Document No. 419273, with regard to the following described real property:
<br />
<br />A parcel of land 16Y2 feet on each side of a centerline described as follows and
<br />containing 2.486 acres, more or less:
<br />
<br />Beginning at a point on the East West Quarter line of Section One ( I ), Township One
<br />Hundred Thirty-eight (138) North, Range Fifty (50) West, Cass County, North
<br />Dakota, said point being 2,179 feet East of the West Section line; thence South
<br />280 I 0' West for a distance of699.8 feet; thence right on a 150 curve for a distance of
<br />160 feet; thence South 52010' West for a distance of 169.1 feet; thence left on a 100
<br />curve for a distance of291.7 feet; thence South 23000' West for a distance of664.8
<br />feet; thence right on a 100 curve for a distance of 400 feet; thence South 63000' West
<br />for a distance of 347.7 feet; thence left on a 250 curve for a distance of 252.7 feet;
