<br />RELEASE OF RIGHT OF WAY EASEMENT

<br />THIS RELEASE, made and entered into this
<br />

<br />CASS COUNTY, a political subdivision under the laws of North Dakota, whose post office address
<br />
<br />is PO Box 2806, Fargo, North Dakota 58108-2806.
<br />
<br />WITNESSETH:
<br />
<br />WHEREAS, CASS COUNTY is the owner of a perpetual easement for the laying out,
<br />
<br />construction, cleaning out, repairing, widening, deepening, extending and maintaining of a public
<br />
<br />drain under a Right of Way Easement dated March 2, 1961, and recorded in the office of the County
<br />
<br />Recorder in and forCass County, North Dakota, on October 3,1975, at 1:01 p.m., in Book "S-6" of
<br />
<br />Miscl., at page 333, as Document No. 494211; and
<br />
<br />WHEREAS, CASS COUNTY desires to release, cancel, and terminate the Right of Way
<br />
<br />Easement dated March 2, 1961, as described above;
<br />
<br />NOW THEREFORE, CASS COUNTY, for and in consideration ofthe sum of One Dollar
<br />
<br />($1.00) and other good and valuable consideration, the receipt and sufficiency of which CASS
<br />
<br />COUNTY hereby acknowledges, does hereby release, cancel, and terminate the above-described
<br />
<br />Right of Way Easement dated March 2, 1961, and recorded in the office of the Cass County
<br />
<br />Recorder on October 3,1975, at 1:01 p.m., in Book "S-6" ofMiscl., at page 333, as Document No.
<br />
<br />494211, with regard to the following described real property:

<br />A strip ofland One Hundred Fourteen (114) feet wide, being Fifty-seven (57) feet
<br />wide on each side of a center line described as follows: Beginning at a point
<br />Seventy-three (73) feet West of the Northeast comer of Section One (1), Township
<br />One Hundred Thirty-eight (138), Range Fifty (50), Cass County, North Dakota;
<br />thence South Sixteen (16) degrees, Ten (10) minutes West a distance of Eight
<br />Hundred Eighty-two (882) feet; thence South Seventy-eight (78) degrees, Seven (7)
<br />minutes West a distance of Fifteen Hundred Seventy-six (1576) feet; thence South
<br />Twenty-six (26) degrees, Ten (10) minutes West a distance of One Hundred Eighty-
<br />one (181) feet to a point on the South line of the North Half of the Northeast Quarter
<br />(NYzNEV.) of Section One (1), Township One Hundred Thirty-eight (138), Range
<br />Fifty (50), which point is Nineteen Hundred Forty-seven (1947) feet West ofthe East
