<br />RELEASE OF RIGHT OF WAY EASEMENT

<br />THIS RELEASE, made and entered into this
<br />
<br />day of

<br />
<br />CASS COUNTY, a political subdivision under the laws of North Dakota, whose post office address
<br />
<br />is PO Box 2806, Fargo, North Dakota 58108-2806.
<br />
<br />WITNESSETH:
<br />
<br />WHEREAS, CASS COUNTY is the owner of a perpetual easement for the laying out,
<br />
<br />construction, cleaning out, repairing, widening, deepening, extending and maintaining of a public
<br />
<br />drain under a Right of Way Easement dated March 3, 1961, and recorded in the office ofthe County
<br />
<br />Recorder in and for Cass County, North Dakota, on October 17, 1975, at 8: 11 a.m., in Book "S-6"
<br />
<br />ofMiscl., at page 468, as Document No. 494629; and
<br />
<br />WHEREAS, CASS COUNTY desires to release, cancel, and terminate the Right of Way
<br />
<br />Easement dated March 3,1961, as described above;
<br />
<br />NOW THEREFORE, CASS COUNTY, for and in consideration of the sum of One Dollar
<br />
<br />($1.00) and other good and valuable consideration, the receipt and sufficiency of which CASS
<br />
<br />COUNTY hereby acknowledges, does hereby release, cancel, and terminate the above-described
<br />
<br />Right of Way Easement dated March 3, 1961, and recorded in the office of the County Recorder in
<br />
<br />and for Cass County, North Dakota, on October 17, 1975, at 8: II a.m., in Book "S-6" ofMiscl., at
<br />
<br />page 468, as Document No. 494629, with regard to the following described real property:
<br />
<br />A strip ofland One Hundred Fourteen (114) feet wide, being Fifty-seven (57) feet on
<br />each side of a centerline described as follows: Beginning at a point on the North line
<br />ofthe South Half ofthe Northeast Quarter (SV,NEY.) of Section One (1), Township
<br />One Hundred Thirty-eight (138), Range Fifty (50), Cass County, North Dakota,
<br />which point is One Thousand Nine Hundred Forty-seven (1947) feet West of the East
<br />line of said Section One (1) as above described; thence South 26010' West a distance
<br />of Five Hundred Seventy-three (573) feet; thence South 57048' West a distance of
<br />Four Hundred Sixty-two (462) feet, more or less, to the West line of the South Half
<br />of the Northeast Quarter (SV,NEY.) of said Section One (I), which point on the West
<br />line of the said South Half of the Northeast Quarter (SV,NEY.) is Four Hundred
<br />Ninety-two (492) feet North of the Southwest comer of said Northeast Quarter
<br />(NEY.) of said Section One (1); and containing 2.708 acres, more or less.
