<br />RELEASE OF RIGHT OF WAY EASEMENT

<br />THIS RELEASE, made and entered into this
<br />
<br />day of
<br />
<br />, 2006, by
<br />
<br />CASS COUNTY, a political subdivision under the laws of North Dakota, whose post office address
<br />
<br />is PO Box 2806, Fargo, North Dakota 58108-2806.
<br />
<br />WITNESSETH:
<br />
<br />WHEREAS, CASS COUNTY is the owner of a perpetual easement for the laying out,
<br />
<br />construction, cleaning out, repairing, widening, deepening, extending and maintaining of a public
<br />
<br />drain under a Right of Way Easement dated March 2, 1961, and recorded in the office of the County
<br />
<br />Recorder in and for Cass County, North Dakota, on October 17, 1975, at 8: I 0 a.m., in Book "S-6"
<br />
<br />ofMiscl., at page 467, as Document No. 494628; and
<br />
<br />WHEREAS, CASS COUNTY desires to release, cancel, and terminate the Right of Way
<br />
<br />Easement dated March 2, 1961 described above;
<br />
<br />NOW THEREFORE, for and in consideration of the sum of One Dollar ($1.00) and other
<br />
<br />good and valuable consideration, the receipt and sufficiency of which CASS COUNTY hereby
<br />
<br />acknowledges, does hereby release, cancel, and terminate the above-described Right of Way
<br />
<br />Easement dated March 2, 1961, and recorded in the office of the Cass County Recorder on October
<br />
<br />17,1975, at 8:10 a.m., in Book "S-6" ofMiscl., at page 467, as Document No. 494628, with regard
<br />
<br />to the following described real property:

<br />A strip ofland One Hundred Fourteen (114) feet wide, being Fifty-seven (57) feet on
<br />each side of a centerline described as follows: Beginning at a point on the East line
<br />ofthe Northwest Quarter of Section One, Township One Hundred Thirty-eight (138),
<br />Range Fifty (50), Cass County, North Dakota, which point is Four Hundred Ninety-
<br />two feet (492) North of the Southeast comer of said Northwest Quarter of said
<br />Section One (I); thence South Fifty-seven (57) degrees, Forty-eight (48) minutes
<br />West, a distance of Two Hundred Fifty-four feet; thence South Twenty-eight (28)
<br />degrees, Twenty-three (23) minutes West, to the South line ofthe Northwest Quarter
<br />of said Section One (I) as above described, a distance of Three Hundred Ninety-
<br />seven feet (397') more or less, and containing 1. 704 acres, more or less.
