County Drain No. 21; thence North 44° 16'08" West along the Northeasterly Right-of- Way of said Cass County Drain No. 21 for a distance of 841.11 feet; thence North 02°56'15" West along the Easterly Right-of-Way of Cass County Drain No. 21 for a distance of 105.93 feet to the point of beginning; thence continue North 02°56'15" West along said Easterly Right-of-Way of Cass County Drain No. 21 for a distance of 625.45 feet to a point on the North Line of the Southeast Quarter of the Southwest Quarter (SE¼SW¼) of said Section Thirty-one (31); thence South 89° 19'41" East along said North Line of the Southeast Quarter of the Southwest Quarter (SE ¼ SW¼) of said Section Thirty-one (31) for a distance of 747.51 feet; thence South 37009'43'' West for a distance of 837.11 feet; thence North 62°11'11" West for a distance of 193.98 feet; thence South 44°11'37" West for a distance of 54.75 feet to a point on said East Right-of-Way of Cass County Drain No. 21, the point of beginning. Said tract contains 7.14 acres, more or less. The purpose of this Quit Claim Deed is to release, convey and terminate any and all interest that the County of Cass has received in and to the following two public road right-of-ways, to-wit: First released, conveyed and terminated road right of way: A public road right-of-way given by OlufP. Kyllo, as grantor, to the County Cass, as grantee, in a Warranty Deed, dated December 4, 1912, filed December 5, 1912, in Book 104 of Deeds at page 201, over a strip of land two rods wide immediately adjoining and along the North bank of the Sheyenne River as the same flows through the Southeast Quarter (SE¼) of the Southeast Quarter (SE ¼) of Section Thirty-one (31) in Township One Hundred Forty (140) North of Range Forty-nine (49) West of Reed Township to be used as and for a public highway. Second released, conveyed and terminated road right-of-way: A public road right-of-way and a Warranty Deed given by OlufP. Kyllo as grantor, to Cass County, as grantee, dated February 4, 1926, filed March 24, 1926, in Book 136 of Deeds at page 46, over a strip of land lying in the Southeast Quarter (SE¼) of Section Thirty-one (31) in Township One Hundred Forty (140) North of Range Forty-nine (49) West of the Fifth Principal Meridian Thirty-three (33) feet on either side of the following described center line; beginning at a point 499.8 feet West of the Southeast comer of Section Thirty-one (31) in said township and range, thence Northwesterly on a 14° curve right, a distance of 357.5 feet; thence North 59° and 37" West a distance of 263 feet; thence Northwesterly and Southwesterly on a 14° curve left, a distance of 534.5 feet; thence South 65° and 13" West (crossing the Sheyenne River) a distance of 896.9 feet; thence Southwesterly on a 7° and 10" curve right, a distance of 330.7 feet to the South line of said Section Thirty-one (31 ), excepting all that land lying Thirty-three (33) feet on either side of said Section line, said tract containing 3.111 acres, more or less. Grantor reserves all public road easements or road right of ways it has in the above described real property conveyed to grantee except the two public road right of ways, described herein, which are specifically released, conveyed and terminated by this quit claim deed. It is the intent of the grantor to reserve all easements and road right-of-ways in and to Cass County Highway No. 17 and Cass County Highway No. 10 (12th Avenue North, West Fargo) as said highways are presently constructed. IN TESTIMONY WHEREOF, the grantor has caused these presents to be executed in its corporate name by its Chairman of the Board of County Commissioners and its County Auditor and its corporate seal to be hereunto affixed.
