<br />.. ) <br /> <br />ASSIGNMENT OF DRAIN PIPELINE EASEMENT <br /> <br />KNOW ALL MEN BY THESE PRESENTS, That CASS COUNTY, a political <br /> <br />subdivision under the laws of North Dakota, GRANTOR, whose post office address is PO Box 2806, <br /> <br />Fargo, North Dakota 58108-2806, in consideration ofthe sum of ONE DOLLAR ($1.00) and other <br /> <br />good and valuable considerations, the receipt and sufficiency of which GRANTOR acknowledges, <br /> <br />does hereby sell, assign, transfer, and grant to Southeast Cass Water Resource District, a political <br /> <br />subdivision under the laws of North Dakota, ASSIGNEE, whose post office address is 1201 West <br /> <br />Main Avenue, West Fargo, North Dakota 58078-1301, its successors and assigns, all of <br /> <br />GRANTOR's rights and interest in and to that certain Drain Pipeline Easement dated November 18, <br /> <br />1996, recorded in the office of the Cass County Recorder on November 18, 1996, at 2:00 p.m., as <br /> <br />Document No. 865651, regarding the following-described real property, to wit: <br /> <br />A Permanent Easement across part of the SE 1/4 of Section 7, Township 138 North, <br />Range 49 West, ofthe 5th Principal Meridian, Cass County, North Dakota, all lying <br />within Lot I, Block 1, of Holmen's Second Subdivision, described as follows: <br /> <br />A strip of land 50 feet wide, 25 feet on each side of the centerline of a 36 inch diameter <br />offtake culvert as presently installed on said Lot 1, commencing on the east property line of <br />Lot 1,66.14 feet south of said north lot line, then southwesterly along said culvert centerline <br />to its intersection with the centerline oftheSheyenne River. Containing 0.328 acres more <br />or less. <br /> <br />GRANTOR does hereby assign and convey to ASSIGNEE all of GRANTOR's rights and <br /> <br />interest created in the above-described real property, with all the rights contained in that Drain <br /> <br />Pipeline Easement described above, including all of the rights of access to the premises for <br /> <br />maintenance, repair, and/or reconstruction of the offtake culvert, floodgate, and associated <br /> <br />appurtenances on the premises. GRANTOR further agrees the offtake culvert, including any main <br /> <br />service entrance structures installed on the premises, shall be the property of ASSIGNEE, with all <br /> <br />the rights that accompany ownership. GRANTOR covenants it has good, right, and lawful authority <br /> <br />to assign its rights and interest in the above-described real property, as well as the offtake culvert, <br /> <br />floodgate, and associated appurtenances located on the premises, created by that Drain Pipeline <br />
