Transportation: WEST FARGO shall be responsible for transportation to and from the detention center <br /> <br />of any juveniles which WEST FARGO desires CASS to detain at the Detention facility. Also refer to section on <br />Medical Care. <br />5. Medical Care: It is expressly understood between the parties that CASS will be providing only detention <br /> <br /> <br />of the said juveniles. WEST FARGO expressly agrees to assume and pay for any additional expenditure, including, <br /> <br /> <br />without limitation, expenditures for the medical and dental care or treatment for juveniles. Necessary medical <br /> <br /> <br />treatment shall include emergency care and life threatening situations or such treatment or medications as may be <br /> <br />required in order to maintain the health or well being ofthe juvenile while incarcerated, including but not limited to, <br /> <br />emergency room care, hospitalization, prescriptions, surgery, or ambulance service. Necessary medical treatment <br /> <br />shall not include elective medical or dental care which would normally be provided by the juvenile. CASS will <br /> <br />notify WEST FARGO within a reasonable time if a juvenile is incurring medical or dental expense or has been <br /> <br /> <br />transferred to a medical facility. <br /> <br /> <br />WEST FARGO is responsible for transportation to and from the detention facility for medical purposes. <br /> <br /> <br />Should WEST FARGO request and CASS has staff available, WEST FARGO agrees to reimburse CASS for <br /> <br /> <br />transportation to and from the detention facility for medical purposes. The reimbursement amount shall be the <br /> <br /> <br />actual cost incurred, such as emergency ambulance care costs, or if a Cass County vehicle is utilized, then the <br /> <br />reimbursement amount shall be at the current federal rate per mile. In addition, WEST FARGO shall reimburse <br /> <br /> <br />CASS at the rate of Thirty-Five Dollars ($35.00) per man hour, with a three hour minimum, for each correctional <br /> <br /> <br />officer or swom law enforcement officer provided by CASS when supervising the juvenile outside the detention <br /> <br /> <br />facility. <br /> <br />6. Applicable Law: This agreement shall be governed by and construed in accordance with the provisions <br /> <br />of the North Dakota Century Code and all rules and regulations promulgated pursuant thereto governing the care and <br /> <br />Page 2 of 4 <br />
