AGREEMENT THIS AGREEMENT is made and entered into this ~ day of yY) 4 i , 2006, by and between Cass County Government, by and through the Cass County Sheriff's Office, State of North Dakota (hereafter "CASS") and County of BARNES (hereafter "BARNES"). WITNESSETH, that for and in consideration of the mutual covenants and agreements herein contained, the parties agree as follows: I. Scope of Service: CASS shall provide detention facilities for the holding of juveniles for unruly or delinquent acts pursuant to Chapter 27-20 of the North Dakota Century Code, and all necessary and incidental services associated with such detention of juveniles, at the Cass County Juvenile Detention Center located at Fargo, North Dakota. 2. Payment: BARNES shall pay CASS at the rate of One Hundred Fifty Five Dollars ($155.00) per day per juvenile, which rate shall apply for any day or any part of anyone 24-hour period (midnight to midnight) during which any juvenile of BARNES shall be housed in the Detention facility. Cass will bill for the day of arrival, but not for the day of departure if different from the day of arrival. 3. Term: The term ofthis Agreement shall be continuous provided, however, that it may be modified or cancelled only upon thirty (30) days written notice by either party. All changes or modifications shall be subject to the written approval of both ofthe parties. In any event, this agreement shall remain in full force and effect until modified or cancelled by one or both parties.
