<br />CASS COUNTY <br />COMMISSION POLICY MANUAL <br /> <br />38.18 <br /> <br />SUBJECT: ORDINANCE #2006-1 (CASS COUNTY SUBDIVISION ORDINANCE) <br /> <br />ADOPTED DATE: MARCH 6, 2006 <br /> <br />PAGE 1 OF 1 <br /> <br />AN ORDINANCE REGULATING SUBDIVISIONS IN CASS COUNTY: <br /> <br />WHEREAS, The County of Cass has a Home Rule Charter, enacted in 1994 pursuant <br />to North Dakota Century Code Chapter 11-09.1; and <br /> <br />WHEREAS, within the Home Rule Charter Article 2, the electors granted the Cass <br />County Board of Commissioners authority to provide for public health, safety and welfare, <br />and to provide for zoning, planning and subdivision of public or private property within the <br />county limits but outside the zoning authority of any city or organized township; and <br /> <br />WHEREAS, the Board of County Commissioners is responsible for the regulation of <br />subdivision within the zoning authority of the organized townships, and the organized <br />townships are responsible for the regulation of zoning, as generally recognized under the <br />"Planning Function of Cass County," adopted May 3, 1993. <br /> <br />NOW, THEREFORE, be it ordained by the Board of Commissioners of the County of <br />Cass that the Cass County Subdivision Ordinance, which is attached and incorporated by <br />reference, is hereby enacted this 6th day of March, 2006. <br /> <br />APPROVED: <br /> <br />ssNern Bennett <br />Vern Bennett, Chairman <br />Board of Commissioners of the <br />County of Cass <br /> <br />ATTEST: <br /> <br />ss/Michael Montplaisir <br />Michael Montplaisir, County Auditor <br /> <br />(SEAL) <br /> <br />First Reading: <br />Second Reading: <br />Final Passage: <br />Publication: <br /> <br />02/06/2006 <br />03/06/2006 <br />03/06/2006 <br />02/13/2006 <br /> <br />HISTORICAL REFERENCE DATE: <br /> <br />MARCH 6, 2006 <br />
