<br />RESOLUTION #2006-4 <br />ADOPTING EXCISE TAX FOR EMERGENCY SERVICE COMMUNICATIONS <br />SYSTEM E-911 <br /> <br />WHEREAS, The North Dakota State Legislature in Chapter 57-40.6 of the North <br />Dakota Century Code has a process by which counties can generate income through an <br />excise tax on the use of telephone access lines and wireless service in order to finance an <br />emergency 911 telephone system; and <br /> <br />WHEREAS, The citizens of Cass County voted to implement an emergency 911 <br />telephone system in 1988 and to levy a $.50 per access line; and <br /> <br />WHEREAS, The citizens of Cass County voted to implement an emergency 911 <br />telephone system in 2000 and to levy a $1.00 per access line; and <br /> <br />WHEREAS, The Board of County Commissioners of Cass County extended the <br />emergency 911 telephone levy to wireless service in 2001 as allowed by Chapter 57-40.6 of <br />the North Dakota Century code to finance upgrades to the infrastructure necessary to <br />provide wireless enhanced 911 service; and <br /> <br />WHEREAS, The Board of County Commissioners of Cass County deems it to be a <br />health and safety benefit for the county to continue to have an emergency 911 telephone <br />system; and <br /> <br />WHEREAS, The Board of County Commissioners of Cass County are facing <br />increased costs for operation of the emergency 911 telephone system; and <br /> <br />WHEREAS, The North Dakota State Legislature in Chapter 57-40.6 of the North <br />Dakota Century Code requires the continuation of the excise tax to be accomplished by a <br />resolution of the Board of County Commissioners; <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners, of <br />Cass County, North Dakota, as follows: <br /> <br />1. That the County of Cass continue with the emergency 911 telephone system <br />established in 1988 and extended to wireless service in 2001 for the safety of the <br />citizens of Cass County. <br /> <br />2. That the excise tax shall be at a rate of $1.00 per month per telephone access <br />line and per each wireless service; however, the Board of County Commissioners <br />of Cass County may reduce the excise tax by subsequent resolution if sufficient <br />funds are received to operate and maintain the system. <br /> <br />3. That each of the telephone companies and wireless service providers servicing <br />the geographical areas within Cass County in which this excise tax is to be <br />imposed, shall collect the excise tax by including such tax, separately stated, in <br />the regular monthly billing statement sent to their subscribers. Additionally, each <br />such telephone company and wireless service provider shall pay, within 30 days <br />after it is collected from the subscriber, the full amount of such excise tax <br />provided, however, each such telephone company and wireless service provider <br />
