INTERGOVERNMENTAL AGREEMENT Animal Pound Services TillS AGREEMENT, made and entered into this -P-- day of '7l1()h..{lj) ,2006, by and between THE CITY OF FARGO, NORTH. DAKOTA, CASS COUNTY, a municipal corporation, 200 Third Street North, Fargo, North 'Dakota, hereinafter referred .to as "(;ITY," and CASS COUNTY, NORTH DAKOTA, a corporate body and 'county under the laws of the state of North Dakota, hereinafter referred to as "COUNTY"; WITNESSETH: WHEREAS, CITY has entered into an agreement with Valley Veterinary Hospital, PoCo, a North Dakota Corporation, 3210 Main Avenue, Fargo, North Dakota, (hereinafter "Valley"), whereby Valley agrees to provide services to the City of Fargo and to act as its animal pound and provide related services as explained more fully in the Agreement attached hereto as Exhibit 1; and WHEREAS, Valley has adequate facilities to serve the needs of both the CITY and COUNTY concerning animal control issues; and WHEREAS, CITY and COUNTY agree that Valley will provide such services - .. -- .-' . . -_. for both CITY and COUNTY animals, that Valley will bill and accept payment from CITY for services provided for both CITY and COUNTY animals, and that COUNTY agrees to make an annual payment to CITY as reimbursement for such costs, WHEREAS, the parties wish to define their respective duties and responsibilities; NOW, THEREFORE, for valuable consideration, the parties agree as follows: 1.
