24. MATERIALS AND SERVICES Contractor will furnish all materials, equipment, and services necessary to perform the contract requirernents. Contractor will also furnish appropriate personal protective equipment for two Department representatives at each site. Materials and work in the construction of equipment for this contract will conform to all codes, regulations, and requirements for that equipment. Materials will be manufactured in accordance with the best commercial practices and standards for this type of equipment. 25. RETENTION OF RECORDS Contractor will retain all records relating to this contract for a period of 10 years following the date of final payment The record retention period is automatically extended in the event of any civil, criminal, or administrative action. Any authorized representative of State or the federal government will have access to and the right to examine, audit, excerpt, copy, and transcribe all contract-related records. 26. OSHA REQUIREMENTS Contractor agrees to comply with conditions of the Federal Occupational Safety and Health Act of 1970 (OSHA), as may be amended, if it has a workplace within the state, the standards and regulations issued thereunder and it certifies that all serVices and items fumished and purchased under this contract will conform to and comply with these standards. Contractor further agrees to indemnify and hold harmless State from all damages assessed against Department as a result of the failure of Contractor or its agents, representatives, or subcontractors to comply with the standards and regulations. 27. COMPLIANCE WITH HEALTH AND SAFETY, ENVIRONMENTAL. AND TRANSPORTATION REGULATIONS Contractor agrees to cornply with all applicable federal, state, and local laws and regulations, including the following laws and regulations as may be amended, and any standards and regulations which may be promulgated thereunder. Contractor certifies that both services and items furnished under this contract will comply with all applicable federal and state laws, standards and regulations. Contractor further agrees to indemnify and hold harmless State, its officers, officials, employees, and agents from all damages assessed against State as a result of Contractor's failure to comply with all applicable federal and state laws, standards, and regulations including the following laws and regulations: A. North Dakota Hazardous Waste Management Act (ND.C.C. ch. 23-20.3) and North Dakota Hazardous Waste Rules (N.DAC. Art. 33-24); B. Federal Occupational Safety and Health Act of 1970 (OSHA); C. Federal Resource Conservation and Recovery Act of 1976 (RCRA); 11
