MEMORANDUM OF AGREEMENT SUBMITTED TO THE ADVISORY COUNCIL ON HISTORIC PRESERVATION PURSUANT TO 36CFR800.6(a) Cass County Project Number BRO-0009(030) NDDOT Bridge Number 09-113-39.1 WHEREAS, the North Dakota Division Office of the Federal Highway Administration (FHW A) has detennined that Project Number BRO-0009(030) will have an effect upon a bridge 6 miles east and 6 miles south of Alice, North Dakota, over the Maple River, a property eligible for inclusion in the National register of Historic Places, and has consulted with the North Dakota State Historic Preservation Officer (SHPO) pursuant to 36CFR Part 800, regulations implementing Section 106 of the National Historic Preservation Act (16 U,S.C. 470); and WHEREAS, the North Dakota Department of Transportation and Cass County participated in the consultation and have been invited to concur in this Memorandum of Agreement; and NOW, THEREFORE, FHW A, and the North Dakota SHPO agree that the undertaking shall be implemented in accordance with the following stipulations in order to take into account the effect of the undertaking on historical properties. Stipulations The FHW A will insure that the following measures are carried out: I. The structure shall be recorded in accordance with Section 110 (b) of the National Historic Preservation Act. This shall include Stipulations: A. Write a short narrative summarizing the information present in the State Site (SITS) Form and NODOT files. This narrative shall include a brief history of the bridge, any unusual design or construction elements of the bridge, and a basic description of the location, setting, measurements, construction, and design of the bridge. B. Black and white photographs of the construction details of the bridge shall be taken. Color overview pictures of the bridge including profile views, roadway views, superstructure views, railing views, and substructure views shall be taken. C. A short report presenting the narrative (Stipulation A) and photographs (Stipulation B) shall be developed and produced, Five (5) copies of this report shall be submitted to NDDOT. The report shall be submitted in electronic form in addition to paper copies. Electronic form shall consist of pdjformat and Microsoft Word doc format. Pictures shall be included as high quality tif or jpg files. Electronic versions shall be submitted on optical disc (CD or DVD).
