They are requesting that we allow them to encroach onto the far south portion of our lot in order to install a fence, roughly a strip varying from 25' to 45', The County purchased the lot several years ago to preserve right of way for a bridge replacement project in 2004. The placement of the fence would be 100 feet from the center of 40'h Ave., and would not impact any improvement projects currently planned by the County or the City of Fargo, and would allow access to the newly installed box culvert for routine maintenance. As part ofthe agreement, the County would reserve the right to have the fence removed in the event that the fence interferes with future work. In lieu of rental payments, Mr. Ferguson has proposed to do maintenance on the entire lot. For reference, contracted mowing and weed control costs are estimated at $700 per year, and the Auditor noted the current arrangement for lease of County owned flood lots is $10 per year. The County Auditor and the City of Fargo Engineer have reviewed the document and their suggestions were incorporated. Attached is a map of the area, and a letter from the Fergusons requesting the encroachment. SUGGESTED MOTION: AUTHORIZE CHAIRMAN TO SIGN CONTRACT AND ENCROACHMENT AGREEMENT WITH EDWARD AND LA V ANNA FERGUSON, SUBJECT TO STATE'S ATTORNEY CONCURRENCE.
