<br />Page 8 of 25 <br />Consultant shall require its personnel to perform the services rendered in accordance with <br />accepted principals of its industry in the State of North Dakota. If applicable, Consultant <br />personnel are subject to the rules and regulations of any and all licensing and professional <br />organizations or associations to which those personnel may from time to time belong, and <br />the laws and regulations in the State of North Dakota. <br /> <br />18. STANDARD OF CARE. The standard of care applicable to Consultant’s services will be <br />the degree of skill and diligence normally employed by professional consultants or <br />consultants performing the same or similar services at the time said services are <br />performed. Consultant will re-perform any services not meeting this standard without <br />additional compensation. <br /> <br />19. DISCIPLINARY ACTIONS. Consultant shall immediately notify Owner if any of the <br />personnel assigned to work under a Task Order receives notice of a disciplinary action by <br />any licensing organization. <br /> <br />20. CONSULTANT’S INSURANCE. Consultant shall maintain throughout this Agreement <br />the following insurance: <br /> <br />A. Consultant shall purchase and maintain throughout this Agreement such insurance as <br />is required by this Agreement in the categories and amounts set forth below: <br /> <br />(1) Claims under workers’ compensation, disability benefits, and other similar <br />employee benefit acts; <br /> <br />(2) Claims for damages because of bodily injury, occupational sickness or disease, <br />or death of Consultant’s employees; <br /> <br />(3) Claims for damages because of bodily injury, sickness or disease, or death of <br />any person other than Consultant’s employees; <br /> <br />(4) Claims for damages insured by reasonably available personal injury liability <br />coverage which are sustained: <br /> <br />(a) by any person as a result of an offense directly or indirectly related to the <br />employment of such person by Consultant, or <br /> <br />(b) by any other person for any other reason; <br /> <br />(5) Claims for damages, other than to the work itself, because of injury to or <br />destruction of tangible property wherever located, including loss of use resulting <br />therefrom; and <br /> <br />(6) Claims for damages because of bodily injury or death of any person or property <br />damage arising out of the ownership, maintenance, or use of any motor vehicle. <br /> <br />B.
