Flood Sales Tax Committee—May 6, 2019 3 <br /> <br />Mrs. Scherling asked if there is any sort of project warranty as the dam was <br />constructed somewhat recently. Mr. Opat said something of that nature would <br />depend on the cause of the issue and when it occurred. Too much time has passed <br />in this case, and the original project design implemented vegetation for erosion <br />prevention. Unfortunately, the ground was too saturated to allow for grass to grow. <br />MOTION, passed <br />Mr. Steen moved and Mr. Montplaisir seconded to approve the <br />Upper Maple River Dam Outlet Channel Improvements Project <br />up to 75% of the local share, up to $21,233.13. Discussion: Mr. <br />Montplaisir asked if remaining funds for the Maple River Dam <br />study and construction projects can be utilized for this project. <br />Mr. Opat said he will find out if those projects can be closed out <br />and the funds re-appropriated. Motion carried. <br /> <br />6. OTHER BUSINESS <br />Red River Basin Commission Long Term Flood Solutions plan update <br />Mrs. Scherling asked what the timeline of the Long Term Flood Solutions study is. <br />Mr. Preister said they are roughly anticipating completion by August of 2020. <br /> <br />Mrs. Scherling asked how continued mitigation efforts will be taken into account <br />for the study. Mr. Preister said the plan is to only model complete or ongoing <br />construction projects. <br /> <br />2019 flood impacts <br />Mrs. Scherling said she is aware of a ring levee request that may come to this <br />committee from an individual homeowner north of Harwood. <br /> <br />Mrs. Scherling said she is unsure if the policy addresses the ability of a single <br />homeowner to apply for project funds, but the larger concern is that the home in <br />question was recently built. As townships have zoning authority, it is not <br />immediately apparent who is responsible for ensuring that new construction takes <br />potential flooding impacts into account, but it appears that due diligence was not <br />performed in this case. Mrs. Scherling would be more inclined to approve funds for <br />a ring levee for a group of older homes. <br /> <br />Mr. Montplaisir said another matter that came up after spring flooding is a group of <br />homes north of Fargo that have requested to be bought out if a FEMA declaration <br />is made and funds become available. <br /> <br />7.
