<br />Commission Minutes--September 7, 1999 2036 <br /> <br />stipulations being added: 1) that a posted sign be placed off of <br />Interstate 29 indicating there is a 25-ton limit bridge ahead and that it <br />be clearly posted at County Highway 17 from the west; 2) that speed <br />limits be restricted on County Highway 6 to 40 miles per hour for all <br />vehicles; 3) that a Class 1 road restriction be placed on County <br />Highway 6 and that it be modified to allow triple axles to carry 40,000 <br />pounds; and 4) that the County Engineer be directed to issue permits, <br />using his discretion, for heavier loads that need to be transported to <br />residents along this road who have no other access to their property. <br />Discussion: Mr. Wieland said this motion does not include his <br />suggestion to lower the speed limit on County Highway 17, however, <br />other Commissioners felt that should be a separate issue to be <br />discussed with those respective property owners before Board <br />action. Mr. Meyer asked about enforcement of the weight and speed <br />limits, and Jim Thoreson, Chief Deputy for the Cass County Sheriff's <br />Department, was present and said he agrees with setting the speed <br />limit the same for all vehicles. As far as weight restrictions, he said <br />the North Dakota Highway Patrol could be contacted about enforcing <br />those restrictions. At the call for the question and upon roll call vote, <br />the motion carried unanimously. <br /> <br />RESOLUTION #1999-15 TO IMPLEMENT COUNTY ROAD WEIGHT RESTRICTIONS <br />WHEREAS, Because of deterioration to Cass County Highway 6 between County Highway 17 <br />and Interstate 29, it may be seriously damaged or destroyed unless the weight of <br />vehicles thereon is limited; and <br /> <br />WHEREAS, The Cass County Board of Commissioners desires to prevent serious damage to <br />county highways; and <br /> <br />WHEREAS, Section 39-12-03 of the North Dakota Century Code authorizes local authorities <br />to impose vehicle weight restrictions on county highways. <br /> <br />NOW THEREFORE, BE IT RESOLVED, BY THE BOARD OF COMMISSIONERS OF CASS <br />COUNTY, NORTH DAKOTA, <br />That Class 1 Load Restrictions will be imposed upon Cass County Highway 6 between <br />Cass County 17 and Interstate 29 frontage roads effective September 8, 1999 with the <br />following stipulations: <br />1) Posting signs where appropriate indicating there is a 25-ton limit bridge ahead; <br />2) Restricting speed limit to 40 miles per hour for all vehicles; <br />3) Posting Class 1 road restrictions with modifications to allow triple axles to carry <br />40,000 pounds; <br />4) Directing the County Engineer to use his discretion in issuing permits for heavier <br />loads that need to be transported to residents along this road who have no other <br />access to their property. <br /> <br />Dated at Fargo, North Dakota, this 7th day of September, 1999. <br />
