<br />Commission Minutes--January 4, 1999 1919 <br /> <br />12. FLOOD UPDATE, Report from Lake Agassiz Regional Council <br />Irv Rustad, Lake Agassiz Regional Council, provided copies of a memorandum from the North <br />Dakota Division of Emergency Management dated December 7,1998, authorizing acquisition <br />of 13 properties on the Phase II listing in the Forest River area. <br /> <br />Demolition work is completed on previously acquired properties and basements have been <br />filled, according to Mr. Rustad; however, some work remains in the spring as far as grass <br />planting and taking care of water wells. He said a financial report will be provided at the next <br />meeting, and the board also needs to discuss future use of the properties. <br /> <br />13. RESOLUTION #1999-1, Two-year tax exemDtion on new home construction <br />Michael Montplaisir, County Auditor, asked if the Commission wants to continue offering an <br />incentive for new home construction whereby the original home owner is granted a two-year tax <br />exemption on the first $75,000 of improvements for a single family residential property. Other <br />than the City of Fargo and the City of West Fargo, Tax Equalization Director Frank Klein said <br />the county processes about 20 such applications per year. <br />MOTION, passed <br />Mr. Wieland moved and Mrs. Schneider seconded to adopt Resolution <br />#1999-1 as follows: On roll call vote, the motion carried with four <br />members voting "Aye" and Mrs. Quick opposing. <br /> <br />RESOLUTION #1999-1 <br />WHEREAS, Section 57-02-08(36) of the North Dakota Century Code permits up to <br />$75,000 of the true and full value of all single family residential property, <br />exclusive of the land on which it is situated, to be exempt from the taxable <br />year in which construction is begun. <br />NOW, THEREFORE, BE IT RESOLVED, That the Board of Cass County <br />Commissioners, in accordance with Section 57-02-08(36), N.D.C.C., hereby grants <br />approval of a two-year tax exemption for new homes started between January 1, 1999, <br />and December 31,1999. <br /> <br />14. ROAD RESTRICTIONS ON COUNTY ROAD #1, ReQuest from Pak Ag Services <br />Keith Berndt, County Engineer, provided a memorandum dated December 23, 1998, indicating <br />he received another request from Joe Killoran of Pak Ag Services, Inc. for special consideration <br />of lifting the spring load limits on a stretch of County Road #1 near Tower City, ND. This item <br />was tabled at the last Commission meeting and Mr. Berndt suggested discussing it with the <br />County Road Advisory Committee because of financial implications and setting a precedent. <br /> <br />Mr. Killoran, however, wants the road restriction lifted this spring for business reasons and has <br />agreed to pay $750, which is estimated to be one-half of the cost of additional road repairs due <br />to the higher weight limit on the first half mile north of Interstate 94. Mr. Berndt said he is willing <br />to approve the request at this time, with the understanding this is for the year 1999 only and that <br />the overall county policy on weight restrictions will be reviewed further, with input from the <br />County Road Advisory Committee. Mr. Koenig said the county might as well approve this <br />request as a test case and collect some revenue to go toward the added repairs. <br />MOTION, passed <br />Mr. Wieland moved and Mr. Koenig seconded to approve a request <br />from Pak Ag Services, Inc. to not post County Highway #1 between <br />
