<br />(f) initiate methods to minimize environmental damage; <br /> <br />(g) provide actual cleanup of spill/incident if necessary; <br /> <br />(h) oversee cleanup of incident if responsible party retains cleanup firm; <br /> <br />(i) provide regulatory support and negotiation for the cleanup; <br /> <br />(j) evaluate long-term effects of spill/incident and make sure cleanup is done with <br />both long and short-term effects taken into consideration; <br /> <br />(k) provide staff augmentation to Fargo Cass County if necessary; and <br /> <br />(1) Wenck will provide a 24-hour, 7 day per week contact and will be available <br />within 2 hours of the call. <br /> <br />(m) Attend monthly Emergency Response meetings and provide telephone assistance <br />as needed to staff with the City of Fargo Cass County. <br /> <br />2.2 Provision of Emergency Response Services <br /> <br />The Company covenants to provide Fargo Cass with the following Emergency Response <br />Services for any Releases when requested by Fargo Cass: <br /> <br />(a) provide emergency response advice and services for all of Fargo Cass's <br />operations, including without limitation: <br /> <br />(i) mobilization of personnel and equipment to the site of a Release; <br /> <br />(ii) advice respecting their professional assessment and opinion regarding <br />containment of the Release; <br /> <br />(iii) advice respecting their professional assessment and opinion regarding <br />removing any Dangerous Product from the Environment following a <br />Release; <br /> <br />(iv) advice respecting their professional assessment and opinion regarding <br />remediation and restoration of the Environment following a Release; <br /> <br />(v) all other services incidental or in association with the foregoing. <br /> <br />(b) <br /> <br />respond promptly to an emergency once activated, regardless of the time of day or <br />the day of the year; <br /> <br />(c) <br /> <br />provide properly trained and equipped personnel to each call unless more are <br />required or requested; and <br /> <br />v3 <br /> <br />-4- <br />
