Effective <br />January 1,2006, we will administer your deferred compensation program in accordance with this <br />Plan Document. <br /> <br />We ask that you: <br /> <br />1. Review the enclosed Plan Document and contact us if you have questions. To help you <br />understand what is new or different, we have prepared an Explanation rifSubstantive Changes, <br />beginning on page 2 of this letter. <br /> <br />2. Please review this document with all appropriate staff and implement this Plan Document <br />no later than December 31, 2005. <br /> <br />o <br /> <br />Retain this document, along with any loan amendments to your previous Plan Document, <br />With your other important papers. <br /> <br />Why has the Plan Document been changed? <br /> <br />On July 11,2003, the United States Department of Treasury issued final regulations for Internal <br />Revenue Code Section 457. The Internal Revenue Service requires that governmental 457(b) plans <br />conform to the final regulations as of January 1, 2006, and issued model amendments as guidance. <br /> <br />Most of the changes in your new Plan Document have been made to be consistent with the language <br />in the model amendments. Also, a few substantive changes were incorporated to provide <br />your participants with additional flexibility with their deferred compensation accounts, as permitted <br />in the final regulations. <br /> <br />Nationwide has made it easy for your Plan to conform to the final regulations. The enclosed <br />Plan Document not only complies with the final regulations, but also includes modifications that are <br />a result of recent IRS regulations, rulings and guidance. <br /> <br />What else do I need to do? <br /> <br />Nothing!
