197 <br /> <br /> Mr. Wieland moved and Mr. Sondrall seconded that a letter of <br />condolence be sent to the family of the late Richard Hilborn, and <br />that the Commission express appreciation for his many years of service <br />on the Housing Authority Board and the County Social Service Board. <br />Motion carried. The Chairman suggested advertising that a vacancy <br />exists on the Housing Authority Board on the March 7th agenda, Which is <br />published in "The Forum", and he requested that the "Cass County <br />Reporter" also make note of the vacancy. Anyone interested in the <br />position should apply to the County Commission. <br /> <br /> County Engineer Don Richards was present concerning his memo <br />dated February 7, 1989, on the Sheyenne Diversion project. He <br />suggested an informal meeting including himse!f, aha or two County <br />Commissioners, and one or two members of the Southeast Cass Water <br />Resource District to develop a written memorandum of understanding on <br />the project. Two bridges will become a part of the County highway <br />system and will be the County's responsibility as far as operation and <br />maintenance once they are constructed. Mr. Shannon asked if there are <br />agreements already in place, and Mr. Richards stated that the only <br />agreements presently are between the Southeast Cass Water Resource <br />District and the Corps of Engineers. He would like to see an agreement <br />whereby the Cass County Commission and the County Engineer would be <br />kept informed on this part of the project. Since the Chairman and <br />Mr. Wieland have the road portfolio, Mr. Eckert stated that they will <br />represent the Commission at a meeting with the water resource district. <br /> <br /> Mr. Sondrall moved and Mr. Wieland seconded that County Engineer <br />Don Richards be allowed out of state travel to the National Association <br />of County Engineers meeting in Kansas during the week of March Z6th. <br />Mr. Richards stated that his expenses will be paid by the North Dakota <br />Association of County Engineers, of which he is currently President. <br />Motion carried. <br /> <br /> Mr. Wielmnd stated that he received a letter from the Chairman of <br />the Stanley Township Board of Supervisors concerning the bridge on <br />County Road 14. He will provide a copy of the letter to Mr. Richards. <br /> <br /> Concerning property south of the Courthouse, Mrs. Toussaint moved <br />and Mr. Shannon seconded that the States Attorney be directed to take <br />the necessary steps to rescind the lease at 910 and 912 Third Avenue <br />South, effective February 28th, but to,keep the option to purchase <br />for which the County has already paid. Mr. Shannon asked what the main <br />reason is for doing this, and Mrs. Toussaint stated that it is due to <br />the State Boiler Inspector's report. She stated that the County was <br />not informed that there was a faulty boiler or that it would need to be <br />replaced. States Attorney Robert Hoy was present and stated that he <br />believes the County can rescind the lease based upon the defective <br />boiler that was obviously known by at least one of the partners owning <br />the property. On roll call vote, the motion carried unanimously. <br /> <br /> Mr. Sondrall left at this time to attend a solid waste workshop in <br />Lisbon, North Dakota. <br /> <br /> <br />
