37 Presiding Judge Norman J. Baokes, East Central Judicial District, was present concerning a vacancy in the Cass County Court due to the appointment of Judge Cynthia Rothe as District Judge, effective March 25, 1988. '1'he Commission received a copy of a letter from Judge Baokes to County Court Judge Donald Cooke offering assistance if it is needed or required to maintain services until a replacement is appointed for Judge Rothe in the County Court. Mr. Wieland moved and Mr. Larson seconded to accept with regrets the letter of resignation from Cynthia A. Rothe as County Judge of the Cass County Court effective March 25, 1988; and that the Chairman send her a letter of appreciation for her work. Motion carried. Upon written recommendation of States Attorney Robert Hoy, Mrs. Stanton moved and Mr. Sondrall seconded that the Chairman be authorized to send a letter to the Secretary of the North Dakota Judicial Nominating Committee advising them of a vacancy for judge in Cass County Court and requesting the committee, within 60 days of this notification, to submit a ii. st of qualified nominees for appointment to this office. Motion carried. Upon the recommendation of County Engineer Don Richards, Mr. Larson moved and Mrs. Stanton seconded to approve payment of City Pothole and Street Repair Funds to the City of West Fargo in the amount of $27,417 and to the City of Leonard in the amount of $468. On roll call vote, the motion carried unanimously. Mr. Larson moved and Mr. Sondrall seconded that the Chairman be authorized to sign the project agreement and the operations and maintenance agreement for critical area treatment project site 4A. Motion carried. Said agreements are on file in the office of the County Engineer. Mr. Sondrall moved and Mrs. Stanton seconded that County Engineer Don Richards be authorized to accept the informal bid of Hall GMC in the amount of $14,728 for a one-ton crew cab 4-wheel drive truck for the Road Department. On roll call vote, the motion carried unanimously. Mrs. Stanton moved and Mr. Larson seconded that Don Richards be authorized to proceed with the preparation for an auction sale of equipment no longer needed at the Road Department, subject to approval of the States Attorney. Motion carried. Commissioner Wieland asked Don Richards to respond to a letter from Mike Gustafson regarding a bridge on the Sheyenne River east of Kindred stating that no decision has been reached by the County Commission on repairing or removing the bridge.
