<br />PART II <br /> <br />Contracting and Construction <br /> <br />1. The County will contract for completion of improvements. On behalf of the <br />County, the City's consulting engineer will: <br />a. Prepare the bid proposals, print and distribute the proposals and plans <br />and solicit proposals, as provided in NDCC Chapter 24-02. <br />b. Consult with the County during design and provide preliminary plans <br />to Cass County prior to finalizing and distributing to bidders. <br />Adequate time should be allowed for Cass County to have five (5) <br />work days to review plans and adequate time forthe consultant to <br />incorporate County revisions. <br />c. Tabulate the bids and prepare contract documents for County- <br />Commission approval. <br />d. Distribute copies of the executed contract, plans, and contract <br />documents to the parties. <br />2. During the construction of the project, the City's consulting engineer will: <br />a. Provide engineering services, material testing, inspection of the work, <br />and administer the construction contract as required by the contract <br />documents and the current edition of the NDDOT's Standard <br />Specifications for Road and Bridge Construction, Sampling and <br />Testing Manual, and Construction Manual. <br />b. Turn over all project records (or a photocopy) and documentation to <br />Cass County at the completion of the project. <br />c. Be responsible for any changes in plan, character of work, quantities, <br />site conditions, or any claim for extra compensation. County <br />participation be limited to the amount stated on page one of this <br />agreement. <br /> <br />PART III <br /> <br />Post Construction: <br /> <br />After the project is completed the City agrees to: <br /> <br />1. Maintain the signing and marking of the project according to the current edition <br />of the Manual on Uniform Traffic Control Devices for Streets and Highways, as <br />supplemented and amended. <br />2. Provide maintenance to the completed project, at its own cost and expense. <br />3. Prohibit encroachments upon the right of way pursuant to 23 CFR Part 1.23, <br />Rights of Way, and Part 710 Subpart D, Right of Way, Real Property <br />Management. <br /> <br />2 <br />
