PART II Contracting and Construction 1. The County will contract for completion of improvements. On behalf of the County, the City's consulting engineer will: a. Prepare the bid proposals, print and distribute the proposals and plans and solicit proposals, as provided in NDCC Chapter 24-02. b. Consult with the County during design and provide preliminary plans to Cass County prior to finalizing and distributing to bidders. Adequate time should be allowed for Cass County to have five (5) work days to review plans and adequate time forthe consultant to incorporate County revisions. c. Tabulate the bids and prepare contract documents for County- Commission approval. d. Distribute copies of the executed contract, plans, and contract documents to the parties. 2. During the construction of the project, the City's consulting engineer will: a. Provide engineering services, material testing, inspection of the work, and administer the construction contract as required by the contract documents and the current edition of the NDDOT's Standard Specifications for Road and Bridge Construction, Sampling and Testing Manual, and Construction Manual. b. Turn over all project records (or a photocopy) and documentation to Cass County at the completion of the project. c. Be responsible for any changes in plan, character of work, quantities, site conditions, or any claim for extra compensation. County participation be limited to the amount stated on page one of this agreement. PART III Post Construction: After the project is completed the City agrees to: 1. Maintain the signing and marking of the project according to the current edition of the Manual on Uniform Traffic Control Devices for Streets and Highways, as supplemented and amended. 2. Provide maintenance to the completed project, at its own cost and expense. 3. Prohibit encroachments upon the right of way pursuant to 23 CFR Part 1.23, Rights of Way, and Part 710 Subpart D, Right of Way, Real Property Management. 2
