RECEIVED AUG 3 0 2005 CASS COUNTY COMMISSION ELM RIVER SNAGGING & CLEARING PROJECT # 1 CASS COUNTY, NORTH DAKOTA PUBLIC HEARING - AUGUST 30, 2005 SCOPE OF WORK The Elm River Snagging and Clearing Project No. 1 will consist of snagging, clearing, and maintenance of the Elm River in Cass County from the north line of Section 4 in Page Township upstream along the Elm River to the Cass County Highway 26 channel crossing in Section 32 of Page Township. Types of work anticipated for completion of the Elm River Snagging and Clearing Project No. 1 include tree removal and disposal, beaver eradication and beaver dam removal, channel bottom sedimentation removal, cattail control and other miscellaneous items for channel maintenance. The special assessments collected for the snagging and clearing project identified above will not exceed $100,000.00. REQUIREMENTS FOR SPECIAL ASSESSMENTS FOR SNAGGING AND CLEARING PROJECTS NDCC 61-16.1-09.1 1) Assessment on property may not exceed $0.50 per acre annually on agricultural lands and may not exceed $0.50 annually for every $500 of taxable value on non-agricultural lands. 2) The project and the assessment district must be approved by a vote of 2/3 of the members of the Water Resource District and by a vote of 2/3 of the members of the Board of County Commissioners. 3) All revenue from an assessment district for a project must be spent prior to creating a new assessment district for additional snagging and clearing within the original assessment district. 4) A public hearing must be held and attended by a quorum of the Water Managers and by a quorum of the County Commissioners.
