<br />RECEIVED <br /> <br />AUG 3 0 2005 <br /> <br />CASS COUNTY COMMISSION <br /> <br />ELM RIVER SNAGGING & CLEARING PROJECT # 1 <br />CASS COUNTY, NORTH DAKOTA <br /> <br />PUBLIC HEARING - AUGUST 30, 2005 <br /> <br />SCOPE OF WORK <br /> <br />The Elm River Snagging and Clearing Project No. 1 will consist of snagging, <br />clearing, and maintenance of the Elm River in Cass County from the north line of <br />Section 4 in Page Township upstream along the Elm River to the Cass County <br />Highway 26 channel crossing in Section 32 of Page Township. Types of work <br />anticipated for completion of the Elm River Snagging and Clearing Project No. 1 <br />include tree removal and disposal, beaver eradication and beaver dam removal, <br />channel bottom sedimentation removal, cattail control and other miscellaneous <br />items for channel maintenance. The special assessments collected for the <br />snagging and clearing project identified above will not exceed $100,000.00. <br /> <br />REQUIREMENTS FOR SPECIAL ASSESSMENTS FOR <br />SNAGGING AND CLEARING PROJECTS <br />NDCC 61-16.1-09.1 <br /> <br />1) Assessment on property may not exceed $0.50 per acre annually on agricultural <br />lands and may not exceed $0.50 annually for every $500 of taxable value on <br />non-agricultural lands. <br /> <br />2) The project and the assessment district must be approved by a vote of 2/3 of the <br />members of the Water Resource District and by a vote of 2/3 of the members of <br />the Board of County Commissioners. <br /> <br />3) All revenue from an assessment district for a project must be spent prior to <br />creating a new assessment district for additional snagging and clearing within the <br />original assessment district. <br /> <br />4) A public hearing must be held and attended by a quorum of the Water Managers <br />and by a quorum of the County Commissioners.
