<br />Commissioner <br />moved its adoption: <br /> <br />introduced the following resolution and <br /> <br />RESOLUTION #2005-15 DECLARING IT NECESSARY TO CONSTRUCT <br />AND MAINTAIN ELM RIVER SNAGGING AND CLEARING PROJECT NO.1 <br /> <br />WHEREAS, the Resolution of the Board of Managers of the North Cass Water <br />Resource District for the establishment of Elm River Snagging and Clearing Project <br />No. 1 having been duly presented to the Cass County Commission; and <br /> <br />WHEREAS, the Cass County Commissioners having reviewed the project and <br />being fully advised in the premises; and <br /> <br />WHEREAS, a public meeting was held on August 30, 2005, at the Page City <br />Auditorium, Page, North Dakota, following published notice. A quorum of the Cass <br />County Commission, and a quorum of the North Cass Water Resource District, <br />landowners within the affected watershed, and other interested persons attended the <br />public meeting; and <br /> <br />WHEREAS, the engineer for the North Cass Water Resource District provided <br />information about the project, and the consensus of those in attendance at the public <br />hearing was to proceed with the project. <br /> <br />NOW THEREFORE, BE IT RESOLVED, that the Board of County <br />Commissioners, Cass County, North Dakota, hereby authorizes, approves, and orders <br />the undertaking of Elm River Snagging and Clearing Project No. 1 in the manner set <br />forth in the Resolution Declaring it Necessary to Construct and Maintain Elm River <br />Snagging and Clearing Project No.1 of the North Cass Water Resource District and in <br />accordance with the engineer's profiles, plans, and specifications therefore; and <br /> <br />BE IT FURTHER RESOLVED, that the particular lots, pieces, or parcels of land <br />which will be benefited by the construction of the project as determined by the North <br />Cass Water Resource District engineer is hereby approved and shall be filed with the <br />Cass County Auditor; and <br /> <br />BE IT FURTHER RESOLVED, that the project shall be financed with funds <br />raised trough the collection of a special assessment to be levied against the land and <br />premises within the watershed benefited by the project in an amount not to exceed 50 <br />cents per acre annually on agricultural lands, and not to exceed 50 cents annually for <br />each $500 of taxable valuation of non-agricultural property; and <br />
