<br />Manager Thompson <br /> <br />introduced the following resolution and <br /> <br />moved its adoption: <br /> <br />RESOLUTION DECLARING IT NECESSARY TO CONSTRUCT <br />THE ELM RIVER SNAGGING AND CLEARING PROJECT NO. 1 <br /> <br />WHEREAS, the Board of Managers of the North Cass Water <br />Resource District has examined a proposed project for the snagging, <br />clearing, and maintenance of the Elm River, a natural water course, <br />in Cass County from the north line of Section 4 in Page Township <br />upstream along the Elm River to the Cass County Highway 26 channel <br />crossing in Section 32 of Page Township. Types of work anticipated <br />include tree removal and disposal, beaver eradication and beaver <br />dam removal, channel bottom sedimentation removal, cattail control <br />and other miscellaneous items for channel maintenance, the project <br />herein referred to as the Elm River Snagging and Clearing Project <br />No. Ii and <br /> <br />WHEREAS, the Board of Managers of the North Cass Water <br />Resource District is of the opinion that further proceedings are <br />warranted. <br /> <br />NOW THEREFORE, BE IT RESOLVED that the purpose of the <br />above-described project is to undertake the snagging, clearing, and <br />maintenance of the Elm River, a natural water course, in Cass <br />County from the north line of Section 4 in Page Township upstream <br />along the Elm River to the Cass County Highway 26 channel crossing <br />in Section 32 of Page Township. Types of work anticipated include <br />tree removal and disposal, beaver eradication and beaver dam <br />removal, channel bottom sedimentation removal, cattail control and <br />other miscellaneous items for channel maintenance; and <br /> <br />BE IT FURTHER RESOLVED, that it is hereby found, determined <br />and declared to be necessary to construct the project; and <br /> <br />BE IT FURTHER RESOLVED, that Moore Engineering, Inc., <br />registered professional engineers, and Ohnstad Twichell, P.C., are <br />hereby designated to assist the Board to gather and prepare <br />profiles, plans and specifications of the proposed project and <br />estimates of the total cost thereof, including cost of acquisition <br />of right of way, such figures to be in sufficient detail to allow <br />the Board to determine the probable share of the total cost that <br />will be assessed against each of the affected land owners in the <br />proposed project assessment district; and <br /> <br />BE IT FURTHER RESOLVED, that the project shall be financed <br />with funds raised trough the collection of a special assessment to <br />be levied against the land and premises wi thin the watershed <br />benefitted by the project in an amount not to exceed 50 cents per <br />acre, annually on agricultural lands and not to exceed 50 cents, <br />annually, for each $500 of taxable valuation of non-agricultural <br />property. <br />
