<br />Public Hearing/Elm River Project--August 30,2005 2 <br /> <br />4. CONSENSUS TO PROCEED WITH PROPOSED ELM RIVER PROJECT <br />Mr. Buringrud asked for a consensus from those present that they agree this snagging <br />and clearing project should be approved. The consensus was there are no known <br />objections to the Elm River Snagging and Clearing Project #1 ; and the sooner it can be <br />started, the better. <br /> <br />A question was asked about possible opposition from landowners who are not present <br />today and how that might delay the project. Mr. Volk said the process is dictated by state <br />law, and the board can only react to complaints as they are filed, Also, he said every <br />property owner in the proposed district that could be identified in the GIS data base <br />received a letter notifying them of today's hearing. Mr. Fredricks said the water resource <br />board is only required to advertise the hearing in the county's official newspaper ten days <br />prior to the public hearing. <br /> <br />Mr. Volk again inquired of the people present if they know of any reason why the water <br />resource managers and county commissioners should not proceed with creating the Elm <br />River Snagging and Clearing Project #1. None of the landowners present voiced <br />opposition to the project. One landowner said he appreciates the work the water <br />resource board has done thus far. <br /> <br />5. APPROVAL BY RESPECTIVE BOARDS <br />The Cass County Board of Commissioners has scheduled a "Resolution Declaring it <br />Necessary to Construct the Elm River Snagging and Clearing Project #1" on the agenda <br />of the next regular meeting, September 6, 2005. Mr. Buringrud said the North Cass <br />Water Resource Board will call a meeting close to the time the county commission meets <br />in order to move forward as quickly as possible with the process. State law requires the <br />water resource board and the county commission having lands benefited by a project to <br />approve the project and assessment by a vote of two-thirds of its members. <br /> <br />6.
