That for and in consideration of the payments to be made by the party of the first part, the contractor promises and agreez to <br />rum Lsh and deliver all labor, equipment, and materials, and to pay or cause to be paid az they become due, ali claims for any wodc, labor, <br />materials, equipment, in¢?uding equipment rental or repair, and other supplies or insurance premiums, all ofwMeh are a~ibutable to or <br />utilized in road repair operations on and adjacent to County and Township H~ghway$ wkb~n Ca.,a County. The contractor shall fomish <br />Clazs 13 gravel only and az directed, In accordance and Jn conformity with the provisions of this contract and the Standard <br />Specifications for Road and Bridge Construction which are hereby made a part of this agreement az fully and to the same effect as ifthe <br />same had been set forth in the body of this ag~eme~ including Se~ion 108.04I pertaining to liquidated damages. References in the <br />Stand~d Sp_ecJficattons_for_Road_.and Bridge Construction. 2002 edition, to the North Dakota Department of Transportation or <br />Department must be construed as referring to the owner. Likewise, n reference by the same works to engineer or direotot must be <br />construed as referring to the owner of the project. <br /> 2. The party of the first part agree~ and promises to pay to the Contractor for said work, when completed and accepted in <br />accordance with the provbions of this ¢on~ract, Class 1.3 gravel delivered from piL~ in Hagen Township, MN at $4.60 per cubic yard <br />plus $0.175 per yard mile to the delivery sites specified by the Cass County Engin~r. <br /> 3. The said work shall be done in accordance with the terms of this contract, and the laws of the Surte of North Dakota subject <br />at all tim~s to the inspection and approval of the engineer. <br /> 4. The decision of the engineer upon questions connected with the execution of this agreement or any fa/lure or delay in the <br />pro~cution of the work by the Contractor shall be final and conclusive. <br /> $.
