The said work shall be done in accordance with the terms of this contract, and tt~ laws of the State of North Dakota subject at ail times to th~ b~ec6.on ~d approval of the engineer. 4. The decision of the engineer upon. qu~fiom, connected w/th the execution of this agreement or any failure or delay in the prosecution of the work by ~.e ¢onlmctor shall be final and concIusive. 5. In the employment of labor, other things being equal, pret~ren~e shall be given to honorably discharged soldiers, sailors and marines, and bona fide North.
