PURCHASE OF SERVICE AGREEMENT Project #2200 Ref: 810-05111 (2005) WHEREAS, the North Dakota Highway Patrol (Department), has determined the services referred to in the paragraph below entitled "Scope of Service" should be purchased; and WHEREAS, Cass County Sheriff's Department, PO Box 488, Fargo, ND 58107-0488 (Local Entity) proposes to provide those services; NOW, THEREFORE, the Department and Local Entity enter into the following: AGREEMENT I. TERM OF THE AGREEMENT The term of this agreement shall be from the 1 st day of August 2005 through the 30th day of March 2006. However, this agreement may be terminated with or without cause by either party giving the other party thirty (30) days prior written notice. II. SCOPE OF SERVICE The Local Entity agrees to conduct an enforcement program that will target violations of laws relating to underage drinking according to the Local Entity's proposal which is attached by reference and made a part of this agreement. Reports are due on a quarterly basis twenty-five (25) days after the end of the quarter with the final report due seven (7) days after the end of the agreement. III. COMPENSATION The Department, upon written request of the Local Entity, agrees to pay the Local Entity based on actual expenses for completing the scope of service. Total payment under the terms of this agreement shall not exceed $5,000.00. Final payment requests shall be submitted to the Department no later than fifteen (15) days after the expiration of this agreement. IV. LOCAL ENTITY'S UNDERSTANDING OF TERM OF FUNDING The Local Entity understands that this agreement is a one-time agreement, and acknowledges that it has been furnished no assurances that this agreement may be extended for periods beyond its termination date. V. LOCAL ENTITY ASSURANCES This agreement shall be construed according to the laws of the state of North Dakota. In connection with the furnishing of supplies or performance of work under this agreement, persons who contract with or receive funds to provide services to the North Dakota Highway Patrol are obligated and agree to comply with all local, state and federal laws, regulations and executive orders related to the performance of this agreement including but not limited to the following: Fair Labor Standards Act, Equal Pay Act of 1963, Titles VI and VII of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, the Age Discrimination Act of 1975, the Age Discrimination in Employment Act of 1967, the Americans with Disabilities Act of 1990, the North -1-
