<br />Commission Minutes--August 1, 2005 2933 <br /> <br />8. CONTRACT APPROVAL, City of Farao rental aareement: State Water Commission <br />amendments to cost participation aareements <br />MOTION, passed <br />Mr. Pawluk moved and Mr. Wagner seconded to approve the following <br />contracts submitted by respective department head, subject to state's <br />attorney approval, and authorize the chairman to sign: On roll call vote, <br />the motion carried unanimously. <br /> <br />City of Fargo--rental agreement for public safety building; <br />North Dakota State Water Commission--Amendment I and II to the Agreement <br />for Cost Participation in the Digital Imagery, Hydraulic Analysis and <br />Topographic Mapping Project for Maple River Flood Insurance Study (the <br />amendments extend the term of agreements through the 2005-2007 biennium, <br />facilitating reimbursement per the terms of the agreements). <br /> <br />9. ORDINANCE #2005-4, Second readina/adoption for financina iail addition <br />Birch Burdick, State's Attorney, was present for the second reading and proposed adoption <br />of an ordinance relating to construction and financing of an addition to the Cass County jail. <br />He is not aware of any changes since the first reading on July 5, 2005, when the county <br />auditor explained the draft ordinance. <br />MOTION, passed <br />Mr. Bennett moved and Mrs. Sorum seconded to adopt the Cass County <br />Jail Addition Project Ordinance #2005-4 to facilitate the construction and <br />financing of an addition to the Cass County Jail. On roll call vote, the <br />motion carried unanimously. <br /> <br />10. WATER RESOURCE DISTRICT, Snaaaina/clearina of Elm River: public hearina set <br />Attorney Sean Fredricks, from Ohnstad Twichell Law Firm, was present representing the <br />North Cass Water Resource Board. Michael Buringrud, Chairman of the North Cass Board, <br />was also present to discuss flood problems in the Page area. One solution might be to <br />establish a special assessment district for a snagging and clearing project on the Elm River. <br /> <br />Under North Dakota Century Code 61-16.1-09.1, Mr. Fredricks said the North Cass Board <br />has the power to assess benefited properties for the snagging and clearing project, at rates <br />established in the statute. Mr. Buringrud said this is an option for the water board to explore <br />if landowners want the board to proceed in that manner. He explained the involvement by <br />the county board of commissioners and said there would be no cost to Cass County. The <br />costs will be borne by the landowners who benefit from the project. <br /> <br />A sample resolution was provided for the county to review and consider at a future meeting; <br />however, prior to the vote, a quorum of the North Cass Board and a quorum of the Cass <br />County Commission must attend a public hearing to discuss the project. Possible dates <br />were discussed, as was a suggestion to hold the meeting in the Page area to make it more <br />convenient for as many landowners to attend as possible, and to be held at a time that is <br />agreeable with the North Cass Water Resource Board. <br />MOTION, passed <br />Mr. Pawluk moved and Mr. Wagner seconded to set a date of August 30, <br />2005, to hold a public hearing in Page for the North Cass Water Resource <br />District snagging and clearing project on the Elm River, at a time set by <br />the water board. On roll call vote, the motion carried unanimously. <br />
