<br />RENTAL AGREEMENT <br /> <br />THIS AGREEMENT, made and entered into this day of <br />, 2005, by and between THE CITY OF FARGO, A MUNICIPAL <br />CORPORATION, (hereinafter referred to as "City"), and CASS COUNTY, NORTH <br />DAKOTA, (hereinafter referred to as "County"). <br /> <br />WITNESSETH, that the City, for and in consideration of the rents and covenants <br />hereinafter mentioned, to be paid by the County, does hereby agree to allow County the <br />use of space for its Emergency Management Office, for members of the SWAT Team <br />from County and for the County's Bomb Squad, at the building and property the address <br />for which is 4630 15th Avenue North, Fargo, North Dakota, and the legal description for <br />which is: <br /> <br />Lot One (1), Block Two (2), Sheyenne Industrial Center 3rd Addition to the City <br />of Fargo, County of Cass and State of North Dakota, according to the certified <br />plat thereof. <br /> <br />The above-described premises will be rented to the County for a term of one year, <br />from and after the day of , 2005, and for additional periods of <br />one year thereafter. In the event either party decides to terminate or not to renew the <br />agreement, notice shall be given in writing to the other party one full year prior to <br />termination. <br /> <br />The County does agree to pay to the City for rental of the above-described <br />premises, the sum of Four Hundred and no/l 00 Dollars ($400.00) per month, for the term <br />of this agreement. Said amount to be due and payable in advance no later than the I st day <br />of each and every month. <br /> <br />IT IS FURTHER AGREED by and between the parties that should the County <br />fail to make the above-mentioned payments as herein specified, then and in that case it <br />shall be lawful for the City to re-enter and take full and absolute possession of the above- <br />rented premises and hold and enjoy the same fully and absolutely, without such re- <br />entering working as a forfeiture of the rents to be paid and the covenants to be performed <br />by the County, for the full term of this agreement. <br /> <br />And, the County also covenants and agrees to and with the City, not to sub-let the <br />above-rented premises or any part thereof, during the full term of this Agreement, <br />without obtaining the consent of the City, and that the County will, at the expiration of <br />the time herein recited, quietly yield and surrender the aforesaid rented premises to the <br />City, in as good condition and repair as when the County took them, reasonable wear and <br />tear and damage by the elements alone excepted. <br />
