CASS COUNTY <br />COMMISSION POLICY MANUAL <br /> <br />39.00 <br /> <br />SUBJECT: <br /> <br />HEALTH INSURANCE PORTABILITY & ACCESSIBILITY ACT (HIPAA) <br /> PAGE 10 OF 10 <br /> <br />Cass County will not retaliate against any person for exercising a <br />right under the HIPAA privacy regulations, or for filing a <br />complaint, participating in an investigation, or opposing any <br />lawful act relating to the privacy regulations. <br /> <br />Cass County will reasonably safeguard protected IIHI from any <br />intentional or unintentional use or disclosure that is in violation <br />of the HIPAA privacy standards. Records stored in Cass County will <br />be kept secure at all times, and IIHI will not be stored or kept in <br />unsecured areas. <br /> <br />Training: Cass County will train all members of its workforce in <br />the policies and procedures adopted by Cass County necessary to <br />comply with the HIPAA privacy regulations. Department staff will <br />receive initial training at the time of implementation of the <br />privacy regulations. Additional training will be provided to each <br />new member of Cass County's work force at the time of hire, and <br />each member of the workforce whose functions are affected by a <br />material change in the required policies or procedures. <br /> <br />Cass County will apply appropriate disciplinary sanctions to <br />employees who fail to comply with Cass County's privacy policies or <br />procedures or who fail to comply with the HIPAA privacy <br />regulations. <br /> <br />HISTORICAL REFERENCE DATE: JANUARY 21, 2003 <br /> <br />K: \ BJ \HI PAA- POLI CYI 2 - 11 - 0 2. doc <br /> <br />SUGGESTED MOTION: <br />Move to amend the Commission and Personnel Policy Manuals to add a policy on Health <br />Insurance Portability and Accessibility Act (HIPAA). <br /> <br /> <br />
