CONTRACT FOR LEGAL SERVICES <br /> <br /> The Board of County Commissioners hereby retain and employ Robert G. Hoy and Ohnstad <br />Twichell, P.C., as legal counsel for Cass County, North Dakota, solely for the purposes of providing <br />legal representation to the County in connection with the County's efforts to salvage portions of the <br />original jail and Sheriff's residence. <br /> <br /> In return for such professional legal services, the County agrees to pay reasonable attorney's <br />fees for Mr. Hoy and such other attorneys at Ohnstad Twichell, P.C., as may be utilized in <br />representing the County in this matter, such attorney's fees not to exceed the rate of $150 per hour. <br /> <br /> In addition to the professional attorney's fees described above, the County also agrees to pay <br />in a timely manner all reasonable costs and expenses incurred on its behalf during the course of <br />representation. Such costs and out-of-pocket expenses would include such items as court costs, <br />subpoena costs, process service fees, photocopies, witness fees, mileage and travel expenses, court <br />reporter costs, expert fees and expenses, legal computer research expenses, filing fees, postage, and <br />similar items. <br /> <br /> Ohnstad Twichell, P.C., agrees to provide Cass County an itemized monthly statement of <br />legal services provided and expenses incurred on the County's behalf in connection with this matter. <br />Mr. Hoy and Ohnstad Twichell, P.C., will also provide Cass County, its officials, employees, or <br />agents, periodic updates on the status of proceedings and will otherwise make themselves available <br />for consultation with the County at times necessary or convenient for the County. <br /> <br /> This Contract for Legal Services shall be terminable by either party upon fifteen (15) days <br />prior written notification to the other party at the address shown below. <br /> <br /> This Contract for Legal Services is being executed in duplicate originals and both parties <br />acknowledge receipt of an original document. <br /> <br /> <br />
