6 <br /> <br />Section 9.02 TRANSMISSION TO METRO FLOOD DIVERSION AUTHORITY. Once the <br />Evaluation Team has compiled the scores for all Proposers and short listed three (3) or four (4) <br />Proposers, the Evaluation Team will transmit the results of its evaluation and the Short List to the Executive Director for transmission to the Metro Flood Diversion Authority, its members, and the Metro Flood Diversion Authority Members. <br /> <br />Section 9.03 CCJWRD REVIEW AND APPROVAL. The CCJWRD will concur with the Short List prior to the Metro Flood Diversion Authority’s approval of the Short List. <br /> <br />Section 9.04 METRO FLOOD DIVERSION AUTHORITY REVIEW AND APPROVAL. The <br />Metro Flood Diversion Authority, upon receiving the Short List, will review the Short List, make <br />findings and conclusions, and designate Proposers as Short Listed and eligible for the Request for Proposals selection phase. The Metro Flood Diversion Authority has the final authority to <br />determine, in its best interests, which Proposers will comprise the Short List. <br /> ARTICLE X. PROTEST PROCEDURES Section 10.01 PROTEST. Any Proposer submitting an SOQ may protest the Authority’s <br />Short List by submitting through certified mail or hand delivery such protest setting forth the basis thereof in writing. <br /> <br />Section 10.02 TIMING. In order to receive consideration, protests must be submitted to <br />the Executive Director no later than five (5) calendar days after the Metro Flood Diversion <br />Authority announces the Short List. The written protest must be received by the Executive Director no later than 5:00 p.m. Central Time on the fifth (5th) calendar day. In the event the <br />fifth (5th) day falls on a weekend or an official holiday, the five-day period expires at 5:00 p.m. <br />Central Time on the next regular business day. <br /> Section 10.03 CONTENTS. A protest should contain, at a minimum, the following: <br />(a) Name and address of the protester, including telephone and facsimile numbers <br />and email address; <br />(b) A statement concerning the protester’s interest in the RFQ process; <br />(c) An executive summary of the basis of the protest, not to exceed two (2) pages; (d) A detailed statement of the basis for the protest, including any supportive <br />documents and information; and <br />(e) The relief requested and the reason therefore. <br /> Section 10.04 REVIEW. The Executive Director will review the protest and supportive documents and issue a written decision within five (5) business days of receipt of the protest. <br />The Executive Director, in its sole discretion, however, may take any action or make any request <br />deemed necessary in order to investigate the protest, including extending the time to issue a <br />decision in order to obtain all evidence and other pertinent information. Once the Executive <br />Director makes a written recommendation, it will provide a copy of such to the protester. <br /> DRAFT
