Task Order No. 7, Amendment 0 MFDA Purchase Order No. ________________ Construction Management Services – Work Package 42 In accordance with Paragraph 1.01 of the Standard Master Agreement for Professional Services (“Agreement”), between Diversion Board of Authority now called the Metro Flood Diversion Authority (“Owner”) and CH2M HILL Engineers, Inc. (“Consultant”), dated March 8, 2012, Owner and Consultant agree to the scope of services as follows: The parties agree that in the event of a conflict between prior Task Orders and this Task Order No. 7, the terms and conditions in this Task Order shall prevail, provided however, nothing herein shall preclude Consultant from invoicing for work authorized under prior Task Orders and performed prior to effective date of this Task Order, even to the extent such prior work was revised by this Task Order. All other terms and conditions shall remain the same and are hereby ratified and affirmed by the parties. 1. Specific Project Data A. Title: Construction Management Services – Work Package 42 B. Description: Provide Construction Management Services for Work Package 42 for projects designed by HMG for the Fargo-Moorhead Area Diversion Project (“Project”). C. Background: Consultant is also providing other services to Owner for the Project under the Agreement. This Task Order describes the functions and activities of the Consultant to assist the Owner with the bidding and construction management portions of Work Package 42. 1) Consultant previously performed these services for the Cass County Joint Water Resource District under Task Order No. 2, whose Period of Performance (POP) ends on May 27, 2016. Task Order No. 7 covers bidding, construction management, and other services related to delivery of Diversion Authority construction project requirements. 2) Owner acknowledges that Consultant is also under contract to Owner to provide a range of services (“Program Management Contract”), which include program level management services, financial support, program controls and reporting, contract administration, permitting and permit compliance support, split delivery implementation support, technical and project support services, federal and state legislative support services, public-private-partnership (P3) procurement support, public involvement and outreach services, and agricultural, cemetery, lands and other impacts mitigation support. 3) Owner anticipates the following construction contracts and professional services contracts will be required during the Task Order : a. Construction Management Contracts: i. WP-42A.1/A.3 – In-Town Levees – 4th Street Pump Station and Floodwall ii. WP-42A.2 – In-Town Levees – 2nd Street Pump Station and Floodwall iii. WP-42C.1 – Downtown Levees – Howard Johnson, Fargo Public School, and Feder Realty Demolition DRAFT
