<br /> <br /> <br /> <br /> <br />MEMO <br /> <br />TO: Metro Flood Diversion Authority Finance Committee <br /> <br />FROM: Erik R. Johnson <br /> <br />DATE: May 11, 2015 <br /> <br /> Enclosed is a proposed Third Amendment to the existing Joint Powers Agreement <br />between the city of Fargo, Cass County and the Cass County Joint Water Resource District. As <br />you know, the original joint powers agreement between the three entities was formed at a time <br />when the Diversion Project was still being studied. Since then, a first and second amendment <br />have been added. For example, the second amendment addressed the work on the O-H-B Levee <br />Project. The enclosed third amendment would establish a separate joint powers “board”, which I <br />have entitled the “Dakota Metro Flood Board”. As this amendment suggests, the Dakota Metro <br />Flood Board will consist of seven members, three of which are appointed by Fargo, three by <br />Cass County and one by the Joint Water District. Once this third amendment is approved by the <br />three North Dakota member entities, each of those member entities would presumably appoint to <br />the Dakota Metro Flood Board the same individuals who are currently representing them on the <br />Diversion Authority. In that way, the Dakota Metro Flood Board could schedule a meeting <br />immediately following the monthly meetings of the Diversion Authority and the Dakota board <br />could then act upon recommendations for expenditures and other programmatic or policy <br />decisions of the Diversion Authority and consent, approve and ratify those acts. <br /> <br /> I remit this amendment to the Finance Committee for its review and approval and <br />recommendation to the Diversion Authority at its meeting on May 14th. <br /> <br />SUGGESTED MOTION: I move to recommend approval in concept and form of <br />the Third Amendment to Joint Powers Agreement as proposed. <br /> <br /> <br />cc: Michael Montplaisir <br /> Kent Costin <br />
