COUNTY DEED

<br />This indenture made this 6th day of January, 2003, between the County of Cass, North Dakota,
<br />party of the first part, and City of West Fargo, 800 4th Avenue East, West Fargo, ND 58078, party
<br />of the second part, witnesseth:
<br />
<br />WHEREAS, the real property hereinafter described was acquired by the county through tax deed
<br />proceedings for the nonpayment of taxes levied and extended against said property for the years
<br />1997 to 2001 inclusive, with interest and penalties, and an estimate of 2002 taxes, amounting tot.
<br />the sum of One hundred four and 93/100 ($104.93) dollars; WHEREAS, said real property was
<br />offered for sale, and sold, pursuant to authority to law, on the 6th day of January, 2003, and at
<br />said sale, said second party became the purchaser of the whole thereof, for the sum of One and
<br />no/100 ($1.00) dollars, which has been paid in full;
<br />
<br />NOW, THEREFORE, the said county as party of the first part, in consideration of the premises,
<br />and pursuant to authority of law, hereby assigns, that certain real property situated in Cass
<br />County, North Dakota, described as follows, to wit:

<br />A 40 foot square parcel in Lot 1 (One) Block 1 (One), Armour Industrial Park Addition to the City of West Fargo,
<br />Cass County, North Dakota, described as follows: From the Northwest corner of the NW¼ of Section 5,
<br />Township 139 North, Range 49 West, Cass County, North Dakota, proceed 1039.45 feet East along the
<br />Section line, thence South 0dl0'00" East along the centerline of Cass County Highway 17 1915.00 feet, thence
<br />North 85d12'00" West 538 feet to the point of beginning; thence continue North 85d12'00" Wes, t a distance of
<br />40 feet; thence North 4d48'00" East a distance of 40 feet; thence South 85d12'00" East a distance of 40 feet;
<br />thence South 4d48'00" West a distance of 40 feet to the point of beginning. ~

<br />To have and to hold the above described real property with all of the appurtenances thereunto
<br />belonging to the said party of the second part, City of West Fargo, heirs and assigns forever.
