October 24, 2002
Page 2

The question the board now needs to consider is this. "Do you want to make a motion at this time to end
the collection of the county sales tax at the end of the first quarter in 2003, which is March 31, 2003?
The coar~ty contracts with the North Dakota State Tax Department to collect the sales tax, and the
requirement for implementing or ending a sales tax is that the tax must start or end at the beginning or
ending of a calendar quarter. They also would like to be notified at least a calendar quarter before the
action is to be effective in order to allow them the maximura amount of time to notify the various
vendors that collect the sales tax from customers.

My recommendation, at this time, is that the board considers the option of ending the sales tax collection
on March 31, 2003. This would be in keeping with the intent the comraissioners expressed when
promoting the sales tax as a method of financing the county jail.

Sincerely,

County Auditor

SUGGESTED MOTION:
Move to acka~owledge the intent of the County Commission in passing Ordinance #1999-1 that the sales
tax would sunset at the time sufficient funds were raised to carry out the objectives outlined in the
election on the sales tax issue held on April 20, 1999; and to direct the Cotmty Auditor to inform the
North Dakota Statc Tax Commissioner of thc board's decision to end the sales tax collections effective
March 31, 2003.
