<br />Commission Minutes--July 5, 2005 2921 <br /> <br />Gladen Construction, Inc. for grading project on Cass County Highway <br />14 from the Sheyenne River to Interstate 29 in the amount of <br />$1,201,031.95. <br /> <br />10. ORDINANCE FIRST READING, Cass County Jail Addition Proiect <br />Michael Montplaisir, County Auditor, explained the draft ordinance to facilitate construction <br />and financing of an addition to the Cass County jail located at 450 34th Street South in <br />Fargo. <br /> <br />The proposed ordinance would establish a building committee consisting of Commissioner <br />Vern Bennett, County Coordinator Bonnie Johnson, Sheriff Don Rudnick, Jail Administrator <br />Glenn Ellingsberg, County Auditor Mike Montplaisir, and any other members subsequently <br />appointed by the County Commission. Among other duties, the building committee will <br />review and approve change orders amounting to less than $5,000 per change order or <br />change orders in the aggregate that do not exceed 5% of the bid award. The county <br />commission must approve any individual change orders over $5,000. The building <br />committee will report the status of this project to the county commission through monthly <br />written reports and/or appearances at a regularly scheduled board meeting. <br />MOTION, passed <br />Mr. Bennett moved and Mrs. Sorum seconded to approve the first <br />reading of an ordinance providing for the construction and financing of <br />an addition to the Cass County jail; and to schedule the second reading <br />and adoption for August 1, 2005, allowing time for publishing a <br />summary of the ordinance in the official newspaper at least 20 days <br />before the second reading. On roll call vote, the motion carried <br />unanimously. <br /> <br />11. ROAD DEPARTMENT, Cass County Hiahway 17 issues near Horace <br />Keith Berndt, County Engineer, provided an update regarding access and right of way <br />issues on County Highway 17 in the City of Horace. He drafted a letter for the board's <br />consideration addressed to Mr. Allen Enno, of A.J. Construction, Inc., outlining access and <br />right of way requirements for this area, as contained in the Cass County Highway 17 <br />Corridor Study adopted in 2002. <br /> <br />Mr. Berndt said Cass County has developed plans and policies in an effort to provide a safe <br />transportation system throughout Cass County. Development in Rud's Second Subdivision <br />along County Highway 17 is contrary to county plans, according to Mr. Berndt, and he feels <br />it will impact future traffic patterns in a negative way. The City of Horace approved the <br />development over county objections, and Mr. Berndt said there is a question of where the <br />city's jurisdiction begins and ends, since the property is in Horace, and where the county's <br />jurisdiction begins and ends as the owner of the county highway. <br /> <br />Birch Burdick, State's Attorney, said he contacted Attorney Dan Twichell, who represents <br />the City of Horace, asking questions relating to authority by the local entities. Mr. Burdick <br />has also reviewed attorney general opinions and said the statutes seem to encourage all <br />political subdivisions to reach agreements wherever they can. <br /> <br />Attorney Jonathan Garaas was present and said he has not seen the county engineer's <br />draft letter; however, he represents Mr. and Mrs. Enno, as well as Mr. and Mrs. Rud. He <br />addressed the board and talked about principles of law and the issue of eminent domain. <br />
