PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS <br />OF CASS COUNTY, NORTH DAKOTA <br />An Application for Anhydrous Ammonia License from the State of North Dakota was presented by R.F. <br />"Ron" Dalbey, General Manager of the Peavey Company of Davenport /Durbin, ND. He received a special -use <br />permit from Durbin Township for the Peavey Company to install the facility in the Village of Durbin, and <br />he is now requesting permission from Cass County prior to submitting the application to the State <br />Department of Agriculture for final approval. The States Attorney stated that there is a special chapter <br />of the North Dakota Century Code dealing with anhydrous ammonia facilities requiring a county license and <br />a State license as of June 30, 1985. He cited reasons that the county board may deny the license, one <br />being for failure to comply with local citing requirements. Gerald Moderow, a representative of the <br />Durbin Township Board, was present and stated that the requirements of the Township Board have all been <br />met. <br />Mr. Eckert stated that the condition of County Road 9 in this area is very much a concern, and he <br />suggested that the Peavey Company consider an alternative site. He stated that the road in this area has <br />been a burden on the County from the unit train, and this will be an additional burden. Mr. Dalbey <br />stated that a majority of the product will be delivered by rail, but Mr. Eckert stated that rail service <br />is not as fast and they will also be delivering by semi trucks in the spring when the product is used the <br />most. <br />Mr. Wieland stated that it was a disappointment to the County when the unit -train began operation in <br />this area without the Commission's prior knowledge as it does cause problems on the roads. When the <br />condition of County Road 9 weakens, it will not be a high priority for repair, due to other- priorities <br />and the condition of other roads in the County. County Engineer Don Richards stated that the road has a <br />low weight limit, and Mr. Dalbey has talked to him about this. <br />Mr. Larson moved and Mrs. Stanton seconded that the Chairman be authorized to sign the Application <br />for Anhydrous Ammonia License for the Peavey Company in the village of Durbin according to their <br />application of August 27, 1986. The motion carried on roll call vote with four members voting "Aye <br />Mr. Eckert opposing. <br />Mrs. Stanton moved and Mr. Eckert seconded that the County Engineer and members of his staff be <br />authorized out of state travel to attend a workshop on computers in St. Cloud, Minnesota, on September 8 <br />and 9, 1986. On roll call vote, the motion carried unanimously. <br />Mr. Larson moved and Mr. Sondrall seconded that Vouchers No. 66,823 through No. 67,678 be approved <br />and ordered paid. On roll call vote, the motion carried unanimously. <br />Mr. Sondrall moved and Mr. Larson seconded to accept the resignation of Cass County Planning <br />Commissioner Victor Knudson of Kindred with regrets, and to request him to serve on a three member <br />advisory board. Motion carried unanimously. <br />Mr. Larson moved and Mrs. Stanton seconded to grant permission for out of state travel for Social <br />Services employees Kathy Suedel to attend a staffing in Duluth, MN on September 15, 1986; and for Joyce <br />Temanson to attend a staffing at Fergus Falls, MN on September 5, 1986. On roll call vote, the motion <br />carried unanimously. <br />Mrs. Stanton moved and Mr. Eckert seconded to grant permission for out of state travel for Data <br />Processing Manager Richard Offutt to attend a workshop with the County Road Department on computers in <br />St. Cloud, MN on September 8 and 9, 1986. On roll call vote, the motion carried unanimously. <br />Mr. Larson moved and Mr. Eckert seconded that the Chairman be authorized to sign a resolution <br />recognizing the Fargo Moorhead Civic Opera Company as a "public spirited organization" for the purpose of <br />conducting games of chance at two sites authorized by the Cass County Commission on August 26, 1986. <br />Motion carried. <br />Mr. Eckert moved and Mr. Sondrall seconded to approve the application for a raffle permit for the <br />Norman Lutheran Church of rural Kindred on the date of November 23, 1986. On roll call vote, the motion <br />carried unanimously. <br />The Commissioners received copies of a preliminary schedule dated August 29, 1986, for <br />implementation of the Data Processing Long -Range Plan as prepared by Richard Offutt. <br />Mr. Larson reported that the Regional Law Enforcement Training Center is about $5,000.00 short of <br />funds necessary to pave the parking lot, and he suggested that Cass County contribute the money in order <br />to complete the project this fall, with the understanding that reimbursement will be made by the City of <br />Fargo at the rate of 48% and by the City of West Fargo at the rate of 19 Mr. Larson moved and <br />Mrs. Stanton seconded to authorize the County Sheriff's Department to expend the sum of $5,000.00 for the <br />purpose of blacktopping or hard surfacing at the Regional Law Enforcement Training Center, with the <br />understanding that Cass County will be reimbursed by at least $3,300.00 or the money will be <br />discounted off the County's contribution next year. The motion carried on roll call vote with four <br />members voting "Aye Mr. Eckert voting "Pass <br />The Commission recessed for a meeting of the Cass County Building Authority and upon reconvening, <br />Mr. Larson moved and Mrs. Stanton seconded to approve the Cass County Building Authority's action on <br />Change Order E -8 to Dakota Electric Construction in the amount of $2,495.00 for installation of a remote <br />fire alarm annunciator from the Courthouse south wing to the County Jail.
