REGULAR MEETING OF CASS COUNTY BOARD OF COMMISSIONERS <br />SEPTEMBER 24, 1985 <br />Chairman Ray Larson called the meeting to order and upon roll <br />call, all members were present. <br />Mr. Eckert moved and Mr. Wieland seconded that the minutes of <br />the previous meeting be approved as written. Motion carried. <br />Mrs. Stanton moved and Mr. Sondrall seconded that the Chairman <br />be authorized to sign the utility permit with Northwestern Bell <br />Telephone Company to cross County Road 20 north of West Fargo along <br />County Road 17. On roll call vote, the motion carried unanimously. <br />Mr. Eckert moved and Mr. Sondrall seconded that the Chairman <br />be authorized to sign the Agreement for Road Repair and Street <br />Improvement Funds for the City of Reiles Acres in the amount of $501.00, <br />which was dated on August 28, 1985. Motion carried. <br />County Engineer Don Richards reported that the State Highway <br />Department is allowing a 10t overload on hauling produce on State <br />highways. However, he recommended that Cass County not take any <br />action at this time to allow the 10t overload on County roads, but <br />it can be changed at any time if it becomes necessary. Mrs. Stanton <br />moved and Mr. Sondrall seconded to accept the County Engineer's <br />recommendation on the 10t overload law. On roll call vote, the motion <br />carried unanimously. <br />Upon the request of States Attorney Robert Hoy, Mrs. Stanton <br />moved and Mr. Sondrall seconded to pay the premium of $1,860.00 for <br />professional liability insurance coverage for one year for the six <br />attorneys in the States Attorneys' Office. On roll call vote, the <br />motion carried unanimously. Mr. Hoy stated that he has money in his <br />budget for membership dues in the National District Attorney's <br />Association, which is required in order to participate in this <br />insurance program. <br />Discussion was held with the States Attorney on the Fair Labor <br />Standards Act as it relates to overtime compensation. Mr. Hoy stated <br />that most employees of the County will be allowed to work only 40 <br />hours per week at their regular rate of pay. If they work more than <br />that, they will have to be paid overtime. Exclusions are elected <br />officials, executive and administrative positions, and law <br />enforcement who do not follow a 40 -hour week. These can still receive <br />compensatory time if the Commission so decides. Mr. Hoy suggested <br />that the Commission send a memo to all departments asking them to <br />submit names of employees who have accumulated overtime which has <br />been documented, their current rate of pay and the amount of overtime <br />hours they have accumulated prior to April 15, 1985. Scott Krueger <br />was requested to send out the memo, and the matter will be placed <br />on the agenda for next week. <br />Upon the request of Sheriff Don Rudnick, Mrs. Stanton moved and <br />
